MINUTES <br />CITY COUNCIL <br />OCTOBER 22, 1997 <br />only concern had been the soil, and it was tested and found not to be <br />contaminated. <br />Fahey asked what has been done in other situations where filling occurred <br />without a permit. The City Administrator reported that the City had <br />proposed to do the filling and the property owner chose to do it. If the <br />property is developed in the future, however, the soils will have to be <br />reexcavated and materia(s placed which are appropriate to support a <br />buildin~. <br />Fahey noted that the filling has eliminated a safety hazard. <br />David Klein reported that when the building was razed there was to be <br />some grading done. Klein pointed out that Frattalone razed the building <br />and had taken out permits. Klein suggested that there may have been a <br />permit still in effect to cover the filling that was done given that work was <br />never completed initially. Klein pointed out that the property was <br />supposed to be ~raded and it never was. <br />Doris Klein indicated that the result of liti~ation was that the foundation <br />was not to be disturbed and it was. The property is now filled and a safety <br />hazard no longer exists. Klein indicated that they have retained an <br />attorney to address the matter. <br />In response to Fahey's question, the City Administrator indicated that the <br />assessment hearing for the Klein property would be scheduled for the <br />Council's second meeting in November. <br />CERTIFICATION Mr. LaValle introduced the followin~ resolution and moved its adoption: <br />OF REFUSE/ <br />RECYCLING RF.SOI.UTIONNO. 97-10-263 -APPROVING THE CERTIFICATION <br />BILLS OF UNPAID REFUSE/RECYCLING BILLS TO PROPERTY <br />TAXES <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Morelan, Scalze, Fahey. <br />Nays (0). Resolution declared adopted. <br />FIRE DEPT.'S The City Administrator reported that participation by the Little Canada <br />PARTICIPATION Fire Department in the League of Minnesota Cities Insurance Trust <br />IN LEAGUE'S Pro~ram for Worker's Compensation coverage will result in a premium <br />INSURANCE savings of $5,199. <br />TRUST <br />20 <br />
