MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 1998 <br />Fahey suggested that this amendment broadens the ordinance, and that the <br />City move slowly on the issue by allowin~ the off-premise real estate <br />signs on private property only. <br />It was pointed out that the City still has the provision requiring a <br />Conditional Use Permit for off-premise signs. Any off-premise sign <br />outside the parameters of this ordinance amendment would still require a <br />CUP. <br />Morelan asked if the amendment accomplished what Masterpiece Homes <br />was looking for. The Planner replied that it did with the exception of <br />limiting the off-premise real estate signs to private property. <br />Morelan was not sure the Council received clear direction from the <br />Planning Commission, notin~ that they did not take action to deny the <br />ordinance amendment which would allow off-premise real estate signs on <br />public ri~ht-of-way. <br />The Planner reviewed the Commission's discussion relatin~ to providing <br />property with control over signs bein~; placed in their yards as well as the <br />discussion relating to the permitting process. <br />Pedersen questioned how enforceable the ordinance would be pointed out <br />that the Masterpiece signs which have been up have all been in the right- <br />of-way. Scalze pointed out that the property owners who have these signs <br />in front of their homes would have the ri~ht to pull them out. <br />Pedersen su~~ested that most realtors will not contact a property owner for <br />permission to put up an open house sign for a two-hour period. These <br />signs are being put in the right-of-way and will continue to be. <br />Fahey asked if there was anyone from the general public present wishing <br />to comment on this matter. <br />Dan Mahai, 620 Keller Parkway, stated that he appreciated the fact that <br />the ordinance amendment prohibits off-premise real estate signs in the <br />public right-of-way. Mahai stated that real estate agenda are some of the <br />worst offenders of the City's sign ordinance. The Masterpiece Homes <br />signs have all been placed in the right-of-way. Mahai took issue with an <br />ordinance that would allow off-premise real estate si~ns, but not other <br />signage. <br />Mahai indicated that the rea] estate business has not policed itself relative <br />to signage up to now. Mahai stated that as a resident he would appreciate <br />not havin~ to look at this signage. An occasional open house sign that is <br />
