MINUTES <br />CITY COUNCIL <br />MARCH 25, 1998 <br />SETBACK 30 feet for his property located at 777 East Viking Drive. The Mayor <br />VARIANCE - noted that both the City Planner and Planning Commission have <br />777 E. VIKING recommended approval of the variance request. Fahey further noted <br />DRIVE that Mr. Dick Kimmes, the owner of adjacent property, has requested that <br />as a condition of approval, Mr. Farley be required to have his property <br />surveyed. Fahey pointed out that Mr. Kimmes made this request at the <br />Planning Commission meeting. The Planning Commission discussed it <br />and did not recommend requiring a survey as a condition of the variance <br />approval given that the existing setback of the house was not being <br />changed. The Planning Commission also noted that when the City <br />obtained the right-of-way easement for Gilanderi Lane, the property was <br />surveyed in order to prepare the legal descriptions for the easement. If the <br />house had been encroaching into the road easement, this would have been <br />identified at that time. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Morelan, seconded by Fahey, the public hearin~ was <br />closed. <br />Scalze verified that the setback of the house is not bein~ changed as a <br />result of ihe addition. The Planner replied that that is correct. <br />Fahey felt that Mr. Kimmes is requesting the survey in order to resolve a <br />property line dispute between adjacent property owners. Fahey felt that <br />issue should be worked out between the property owners and should not <br />be made a condition of the variance approval. <br />The City Planner pointed out that at the time the building permit was <br />issued for the remodelin~ of the Farley house, the County's section maps <br />did not show the road easement for Gilanderi Lane. Therefore, the <br />Building Inspector missed the fact that this property had become a corner <br />lot. The Deputy Clerk explained that in recording the road easement, the <br />Land Records Department of Ramsey County failed to change the <br />County's section maps and show the road. This has since been pointed out <br />to the County and the maps are being updated. <br />Morelan asked if the City's taking of road easement for Gilanderi Lane <br />and Viking Drive created any other non-conforming situations. The City <br />Administrator did not believe so, and indicated that the Farley property <br />was the most likely to have been adversely impacted by the easement. <br />Mr. Nlorelan introduced the following resolution and moved its adoption: <br />2 <br />
