MINUTES <br />CITY COUNCIL <br />JANUARY 14, 1999 <br />perhaps the solution is to issue citations and let the courts decide these <br />matters. <br />Morelan stated that he preferred to lead than push. <br />Scalze agreed that there should be fair and equitable treatment between <br />property owners. Scalze suggested that perhaps the best solution would be <br />to offer all CUP's at a reduced deposit for a period of time. <br />Fahey agreed and further suggested that, to the extent possible, the Code <br />Enforcement Of~icer should conduct the reviews and prepare the reports <br />on these CUP applications. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 99-1-6 - ADOPTING THE RECOMMENDATION <br />OF THE CODE ENFORCEMENT OFFICER WLTH REGARD TO <br />THE PROCESSING OF CONDITIONAL USE PERMIT <br />APPLICATIONS FOR RYAN INDUSTRIA7. PARK WITH THE <br />ADDITION OF ALL CONDITIONAI. U,SE PERMITS TO I3E <br />PROCESSED AT A REDUCED DEPOSIT UNDER THE SAME <br />SYSTEM FOR THE FIRST SIX MONTHS OF 1999 CONTINGENT <br />UPON THE CODE ENFORCEMENT OFFICER'S AI37LITY TO <br />HANDLE THE ADDITIONAI. CUP APPI.ICATIONS <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Morelan, Pedersen, Scalze. <br />Nays (0). Resolution declared adopted. <br />FRATTALONE Mayor Fahey noted that the Development Agreement timelines for the <br />RECYCLING Frattalone recycling operation to cease have expired and Frank Frattalone <br />DEVELOPMENT is requesting that the Council extend the termination of operation date. <br />AGREEMENT Fahey stated that he supported allowing the recycling business to continue <br />under some licensing standard rather than amend the ordinance to allow <br />this type of use. Fahey pointed out that standards for this type of business <br />could be set up under a licensing arrangement. <br />Scalze felt that the City needed to be fair to all property owners and that <br />one property owner cannot be allowed to operate a business that others <br />could not. Scalze pointed out that the Frattalone recycling operation is <br />located on eight acres of property. There is only a small building as well <br />as a temporary mobile office on this property that is not in the best <br />interests of economic development. Scalze stated that she did not support <br />allowin~ the continued operation of a stockpiling and recycling operation <br />
