MINUTES <br />CITY COUNCIL <br />JANUARY 19, 1999 <br />The Engineer indicated that this option could be looked at, however, it was <br />not because City policy has been to install concrete curb and gutter as part <br />of street reconstruction projects. The Engineer again pointed out that curb <br />and gutter protects the edge of the road, thus extending the life of the road <br />considerably. Concrete curb and gutter also improves the drainage system <br />for the roadway, as well as helps to prevent snowplows from damaging the <br />edge of yards. The Engineer pointed out that Little Canada is an urban <br />city and should have urban improvements. <br />Johnson questioned why she would be assessed for curb and gutter if there <br />was none installed in front of her property. <br />Scalze replied that the road recycle project would be justification for <br />assessing this cost. <br />The City Engineer reported that City staff is not clear on how the curb and <br />gutter assessment should be addressed, therefore, all property owners <br />abutting the improvement were invited to this hearing. This will allow <br />concerns and issues to be raised for the Council's consideration in making <br />a decision. The decision on the assessment itself does not need to be made <br />until the project is substantially completed. Affected property owners will <br />be invited to the assessment hearing. <br />Johnson hoped that LaBore Road could be widened adjacent to her <br />property so that a pedestrian area could be added. The Engineer indicated <br />that he would work with the County to get the road as wide as possible <br />while still not affecting drainage patterns. <br />Scalze asked how many property owners would like to see paved <br />pedestrian area on the road. John Younker, 935 Westwind Drive, replied <br />that that would depend on the cost. <br />MaryAnn Kuperschmidt reported that they walk and bike along the <br />shoulder of LaBore Road and suggested that the installation of concrete <br />curb and gutter would interfere with those activities. <br />John Younker stated that he objected to being assessed for curb and gutter <br />if none is installed along his property. Younker pointed out that State Law <br />requires assessments to be equal to benefits received. Younker also <br />indicated that the City cannot assess property owners for improvements <br />that the County is makin~; at their cost. Younker stated that if properties <br />are not getting curb and gutter, than they cannot be assessed for it. <br />Younker atso indicated that combining the LaBore Road project with <br />14 <br />
