MINUTES <br />CITY COUNCIL <br />APRIL 14, 1999 <br />*AWARDING 1999 STREET SWEEPING QUOTATIONS AS <br />RECOMMENDED I3Y THE PUI3LIC WORKS DIRECTOR; <br />*APPROVING THE FINAL PAY REQUEST FOR I998 PARKING <br />LOT IMPROVEMENTS A.4 RECOMMENDED 73Y CITY STAFF; <br />"APPROVING THE VOUCHERS <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Scalze, LaValle, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />KLEIN The City Attorney submitted correspondence relative to the Klein <br />LITIGATION litigation for Council information. The Attorney pointed out that Judge <br />Gearin ordered sanctions against the Kleins and Deno Berndt, attorney <br />representing the Kleins, in the amount of $500 relative to their suit against <br />the City. The City will also pursue the taxation of costs and disbursements <br />in the amount of $610.75. <br />AWARD BID The City Attorney reviewed his correspondence dated April 7, 1999 <br />FOR 1999 relative to case law pertaining to the awarding of bids based on previous <br />IMPROVEMENTS experience with a contractor. <br />Fahey noted the recommendation of the City Engineer for awarding the <br />bid to the low bidder, North Valley, Inc. based on his discussions and <br />assurance with the principals at North Valley that this is a different entity <br />than Valley Pavin~;. <br />Brad Schmitbauer, North Valley, appeared before the Council to confirm <br />that No~th Valley was a different entity than Valley Paving and also <br />indicated that there would be a different project foreman on the site than <br />was used by Valley Paving. Schmitbauer also reported that there would <br />be weekly meetings with City staff, the City Engineer, and North Valley <br />for the duration of the project so that communication does not become an <br />issue. <br />Scalze pointed out the concerns that Council Member Morelan had with <br />awarding the bid to North Valley. However, she noted the additional <br />information since the last meeting pertaining to North Valley and the <br />people involved in that company, <br />Fahey pointed out that the City is dealing with different principals as well <br />as a different le~al entity.
