MINUTES <br />CITY COUNCIL <br />APRIL 14, 1999 <br />RICE STREET/ The City Administrator reported that there is no new information <br />LITTLE to report on the Rice Street/Little Canada Road redevelopment area. <br />CANADA RD. Developers are continuing their discussions, but things have not <br />REDEVELOP- progressed to the point where there is anythin~ for the Council to <br />MENT consider. The Administrator reported that he anticipates that Sherman <br />Rutzick will come in with a proposal for the Council to consider some <br />time in May. <br />FILL PERMIT- The Council reviewed Dick Kimmes' application for a fill permit <br />GILANDERI for 1,500 cubic yards on the Gilanderi Addition plat. Scalze <br />ADDITION expressed concern with allowing the filling prior to approval of the final <br />plat. Scalze noted that if the filling is allowed and Mr. Kimmes does not <br />proceed with the final plat, the result may be an unsightly lot without a <br />development. <br />The City Administrator reported that he has not processed the <br />Development Agreement as of yet. He also reported that MN DOT has <br />raised an issue with the looped road system on Hi~hway 36 right-of-way. <br />The City Engineer is working with MN DOT to address their concerns. <br />The City Engineer reported that MN DOT has raised concerns with the <br />looped road system which are contrary to initial discussions on this issue. <br />The Engineer is followin~ up with MN DOT and should know early next <br />week. <br />The City Administrator recommended a cash deposit to cover the cost of <br />removal of the fill and restoration should the final plat not proceed. <br />Scalze did not believe filling should occur until the developer was ready to <br />fill in order to construct a house. <br />The City Engineer reported that 1,500 cubic yards was not a large amount <br />of fi1L The Administrator pointed out that the proposed filling complies <br />with the grading plan for the plat, therefore, staff is comfortable with <br />approval of the fill permit subject to a cash deposit to cover restoration if <br />that becomes necessary. <br />Mr. LaValle introduced the followin~ resolution and moved its adoption: <br />RESOI, UTION NO. 99-4-83 - APPROVING TFIE FII.L PERMIT FOR <br />1, 500 CUI3IC YARDS AS REQ UESTED BY DICK KIMMES FOR THE <br />GII ANDERI ADDITION PI.AT .SUI3.IECT TO COMPLIANCE WITH <br />THE RECOMMENDATIONS OF THE PU73LIC WORKS DIRECTOR <br />AND SU13.IECT TO .SUI3MISSION OF A CASH DEPOSIT A.4 <br />13 <br />
