MINUTES
CITY COUNCIL
JULY 28, 1999
Lesnick's needed a variance for the fence. Mrs. Reeves felt they could not
be held accountable if City staff is incapabie of providing conect
information.
The City Administrator pointed out that the conversations he has had on
this matter have been with Mr. Reeves. The City Administrator indicated
that he explained to Mr. Reeves why a variance was needed and the fact
that the deadline for the July planning cycle had passed. Mr. Reeves was
not happy about having to wait for the August cycle. Therefore, in order
to accommodate him, the deadline was waived.
Mr. Reeves again indicated that it was his understanding that if the
Lesnick's did not pay the vaziance fee by Friday afternoon, a variance for
their property would not be processed.
Pedersen asked if it were true that a notice should not have been published
and mailed until an application with the fee was received. The
Administrator stated that that was correct. However, from a customer
service standpoint he made a decision to process the variance based on the
indication from Mr. Reeves that the Lesnick's were interested.
Mrs. Reeves felt that whatever was required of them to process a variance
should have been required ofthe Lesnick's. Because ofthe City
Administrator's customer service efforts, they will be stuck with the bill
for the Lesnick variance.
Fahey asked for an estimate of the additional expenses. The City
Administrator estimated these to be $125.
Pedersen felt that an error was made in processing a variance for the
Lesnick property without the necessary paperwork. LaValle pointed out
that the effort was made by City staff based on Mr. Reeves' comments.
There was no one else present from the public wishin~ to comment on this
matter.
Upon motion by Fahey, seconded by Scalze, the public heazing was
closed.
Fahey suggested that action on both the Reeves and Lesnick vaziances be
tabled in order for staff to find out the intentions of the Lesnick's with
regard to the fence. Fahey indicated that he is satisfied that there were
representations on the part of Mr. Reeves that the Lesnick's were
interested in a similar variance. Therefore, if the Lesnick's aze not
