MINUTES <br />CITY COUNCIL <br />JULY 28, 1999 <br />semi-trailers, etc. Scalze expressed concern with applying only the <br />pazking,requirements that were part of the 1964 Code without <br />consideration to the other provisions of that Code. Scalze suggested that <br />at the time a property comes in with a Conditional Use Permit application, <br />the City should bring that property up to current zoning standards. Scalze <br />indicated that this has always been the intent of the Council. Scalze <br />suggested that if the number of parking space under current code aze too <br />many, then perhaps the Council should look at that code and redo it. <br />Fahey suggested there were two areas the City Attorney should comment <br />on. First, does the application for CUP trigger the City's ability to apply <br />current zoning standards. Second, if the 1964 Code applies for parking, <br />does the City have the right to apply other standard of the 1964 Code. <br />Fahey asked if the 1964 Code required a CUP for parking. The Zoning <br />Administrator replied that the 1964 Code required a Conditional Use <br />Permit for certain things. However, parking requirements were applied by <br />Zoning District and not by use. <br />Morelan felt that unless certain things are grandfathered in, than the <br />current standards should be applied uniformly. Fahey agreed for things <br />that require a CUP, but was not sure this should be the case for general <br />design standards. <br />The City Attorney suggested that he research these issues and report to the <br />Council at their next meeting. <br />Scalze pointed out that the 1964 Code has some good provisions and <br />addresses parking and off-street loading very clearly. Parking <br />requirements were based on the use, and suggested that for multi-tenant <br />buildings those requirements shou(d be combined to get the total number <br />of parking spaces. <br />Fahey suggested that the Council needs to hear what the City Attorney <br />would be comfortable with enforcing from a le~al standpoint, and whether <br />the City can do wholesale enforcement of 1964 standards or selective <br />enforcement. Then the City needs to determine which properties would be <br />under the 1964 Code requirements. The Zoning Administrator replied that <br />there aze three. <br />Morelan asked how the parking calculations in the current Code were <br />arrived at, asking whether the standard used is a uniform standard for the <br />Metro Area. <br />
