MINUTES <br />CTi'Y COUNCIL <br />JiTLY 28, 1999 <br />The City Administrator indicated that he will have the City Planner <br />prepue a report on this issue for the next Council meeting. It was noted <br />that the City Pianner would not typically be at the first meeting of the <br />month, and his report will be in written format. <br />Fahey agreed that the Council needs to determine if the current parking <br />requarements are out-of-line. <br />Roger Stanke, property owner in Ryan Industrial Park, informed the <br />Council that Art Ryan constnxcted the buildings first before they were sold <br />to particular tenants. Therefore, parking areas were developed prior to the <br />use of the building being known. <br />Scalze agreed, but pointed out at the time there was one tenant to a <br />building. Now there are multiple tenants in each buildings resulting in <br />inadequate parking. <br />Council will discuss this issue further at its August 11'~' meeting. <br />BIAGINI The City Administrator reviewed the proposed Development Agreement <br />DEVELOPMENT with Dick Biagini for development o£ an office building on Country Drive. <br />AGREEMENT The Administrator reviewed several modifications to the Agreement as a <br />result of discussions with Mr. Biagini. The first relate to the TIF standard <br />that there be the creation of new jobs as a result of the development. The <br />Administrator indicated that the development will result in new jobs. <br />However, these will be created by C.I.Title, a tenant of the building, rather <br />than Mr. Biagini. Since Mr. Biagini does not control this factor, it is being <br />recommended that the standard be decreased from 20 new jobs to 5. C.I. <br />Title is anticipating the creation of 40 new jobs. <br />Another provision was added to the Agreement providing for release of <br />Mr. Biagini from the Development Agreement should he not be able to <br />obtain mortgage financing. This provision does require reimbursement of <br />the City's out-of-pocket expenses. <br />Scalze asked if the City has obtained the appraisal on the Precision Tree <br />property. The City Administrator reported that he was told of the figure <br />yesterday, but has not received the appraisal report. <br />Another issue to be addressed by the Development Agreement relates to <br />substantial completion of the project and conveyance of title to the <br />developer of additional Phase I property.. The wording in this provision <br />has been revised so that substantial completion will not include the <br />parking lot given that eminent domain may be necessary to acquire the <br />
