MINUTES <br />CITY COUNCIL <br />AUGUST 25, 1999 <br />Stanke stated that if the building addition would not be approved, then he <br />would pursue the Variance to allow the semi-trucks to park in the required <br />front yard. <br />Morelan asked why the variance is necessary for the west side of the <br />building. <br />Stanke replied that he has a renter who parks semitrucks on the west side <br />of the building. The trucks are 65 to 75 feet long and when parked on the <br />west side of the building extend into the 40 foot required front yard <br />setback. Stanke also indicated that there is approximately 19 months left <br />on the lease with this renter. The renter is currently in his busy season and <br />does not have time to look for another location. Therefore, if the variance <br />is not approved, the renter would need until April 15` before he could <br />vacate the property. <br />Stanke indicated that he contacted the railroad to see if he could purchase <br />some of their right-of-way. However, they indicated they were not selling <br />right-of-way at this time. Stanke pointed out that the City granted <br />Belland's a rear yard setback variance for his building addition. Stanke <br />stated that without approval of the building addition he is proposing, he <br />would like to pursue the setback variance so that his renter can continue to <br />utilize the property. <br />Fahey noted that the Council has no information on the setback variance at <br />this time, therefore, cannot act on it. Fahey indicated that there must be a <br />hardship present in order to warrant a variance. Fahey indicated that he <br />would like to look at the circumstances under which the City granted <br />Belland's a variance. He indicated that the reason might have been in <br />recognition of the large railroad ri~ht-of-way that abuts the north property <br />line. Fahey indicated that the addition to the Stanke building may be an <br />improvement to the property if outdoor storage is eliminated as a result. <br />Stanke indicated that the addition would eliminate outdoor storage on the <br />west side ofthe property. <br />Fahey indicated that Stanke is welcomed to submit building plans and <br />apply for a variance. The Council would review those applications and act <br />on the requests. <br />Stanke indicated that the paving and landscaping improvements he must <br />make to the property will cost between $15,000 and $16,000. Stanke <br />asked that the Council allow for a sunset for the semitruck parking in the <br />front yard setback if the Council is not agreeable to the variance request. <br />19 <br />
