MINUTES <br />CITY COUNCIL <br />AUGUST 25, 1999 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Fahey, LaValle, Scalze, Pedersen. <br />Nays (1) Morelan. Resolution declared adopted. <br />VARIANCE - Mayor Fahey opened the continuation of public hearing to consider <br />78 JESSICA a Variance to allow the construction of an eight and one-half foot <br />COURT - high privacy fence at the rear yard of 78 Jessica Court owned by Mr. <br />LESNICK Jacob Lesnick. It was noted that Mr. Lesnick does not want to proceed <br />with the variance at this time. Morelan su~gested that the Council act on <br />the variance noting that Mr. Lesnick would have up to one year to act on it <br />if he so c6ooses. <br />There was no one from the public present wishing to comment on this <br />matter. <br />Upon motion by Morelan, seconded by LaValle, the public hearing was <br />closed. , <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RE.SOI. UTION NO. 99-8-2I3 - APPROVING THE VARIANCE TO <br />ALLOW CON.STR UCTION OF AN EIC,HT AND ONE-HALF FOOT <br />HIC,H PRIVACY FENCE AT THE REAR YARU OF 78 JESSICA <br />COURTADJACENT TO COUNTYROAD CSU73JECT TO THE <br />APPLICANT'S ACCEPTANCE AND ACKNOWLEDGEMENT OF <br />THEIR 12EPONSII37LITY TO MAINTAIN THE 130ULEVARD AREA <br />BETWEEN THE FENCE AND COUNTY ROAD C, SUBJECT TO <br />THE FENCE HEIGHT FOI,I,OWING THE I.AY OF THE LAND, <br />AND SU73JECT TO THE APPI.ICANT PAYING THE APPROPRIATE <br />FEES SHOUI.D HE DECIDE TO TAKE ADYANTACE OF THE <br />VARIANCE APPROVAI. WITHIN THE ALLOTTEI) TIME FRAME <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (4) LaValle, Fahey, Pedersen, Scalze. <br />Nays (0). Resolution declared adopted. <br />VACATION OF Mayor Fahey opened the public hearing to consider the vacation of a <br />DRAINAGE & drainage and utility easement on the property located at 3087 Stoneridge <br />UTILITY Court as requested by Brenda Grussing. Fahey noted that the Public <br />EASEMENT Works Director has reviewed the request and is recommending approval <br />of the vacation. <br />There was no one present from the public wishing to comment on this <br />matter. <br />
