MINUTES <br />CITY COUNCIL <br />SEPTEMBER 8, 1999 <br />AGREEMENT <br />Scalze sug~ested that the language referring to Outlot A be clarified to <br />indicate that this property is to be preserved for ponding and permanently <br />undeveloped open space. Scalze wanted to ensure that the property was <br />precluded from future development as a park facility and maintained as <br />ponding and open space. <br />Fahey suggested that paragraph j. be amended to include the developer as <br />waiving the right to appeal any special assessments for water main <br />improvement. Fahey noted that water main could be installed next year <br />while the developer may still own some of the lots. Therefore, the <br />developer should be required to waive the right to appeal. Fahey aiso <br />requested that the City Attorney ensure that the development agreement as <br />well as any waivers run with the land so that future property owners are <br />aware of these facts. <br />Morelan suggested that the Fire Chief and Fire Marshal be asked to <br />comment on the feasibility of providing fire protection to these homes if <br />they are constructed with wells. He su~gested that perhaps the option of <br />requiring residential sprinkler systems in these homes should be looked at. <br />Scalze noted that there are approximately 35 to 40 homes in the Twin <br />Lake Blvd./Twin Lake Road/Twin Lake Trail area which are served by <br />wells. Scalze felt that these 12 additional homes should not be required to <br />install sprinkler systems. <br />Fahey felt the answer was to find a way to get the water system in. <br />However, agreed that the Fire Chief should be requested to comment on <br />this issue. <br />Pedersen asked if the lake would be a source of water to fight a residential <br />fire. Fahey reported that the Little Canada Fire Department does not have <br />the equipment necessary to pull water from the lake for fire fighting <br />purposes. <br />LaValle pointed out that the City has mutual aid a~reements with <br />surrounding fire departments. Morelan indicated that a sprinkler system <br />would prevent a fire from reaching the magnitude to where mutual aid <br />would be required. <br />Fahey suggested that the City could act on the development agreement <br />subject to the comments of the Fire Chie£ He suggested that the Chief <br />look at the feasibility of obtaining water from the water main in the John <br />Mitchell Preserve for fire protection for the Twin Lake Pines Addition. <br />
