MINUTES CITY COUNCIL SEPTEMBER 8, 1999 development agreement relating to this issue based on a review and recommendation from the Parks & Recreation Commission. The City Administrator reported that Mr. Pratt would like approval of the development agreement this evenin~ so that he can commence construction of utilities. The Administrator reported that the Council has the ability to made modifications to the development agreement at a later date. Fahey indicated that he was open on the trail issue, but indicated that he felt a 12-foot wide trail was too wide. Pratt indicated that he will continue to work on the trail issue. Mr. LaValle introduced the following resolution and moved its adoption: RESOI. SPECIAI. ASSESSMENTS FOR WATER MAIN IMPROVEMENT, THE CITYATTORNEYADDRESSING THE ISSUE OF RECORDING OF THE DE-/ELOPMENT AGREEMENT AGAINST TH~ SDB.IECT PROPERTIES, AND .SU73JECT TO REVIEW AND COMMENT ]3Y THE FIRE CHIEF ON THE ISSUE OF FIRE PROTECTION FOR THE PROPOSED HOMES IN THE TWIN LAKE PINES ADDITION The foregoing resolution was duly seconded by Morelan. Ayes (5) LaValle, Morelan, Scalze, Pedersen, Fahey. Nays (0). Resolution declared adopted. GOODYEAR The City Administrator presented the Council with a purchase agreement TIRE STORE for the City's purchase of the car wash property on Rice Street as well as PROJECT the property immediately south and 2620 Rice Street from Wild North LLC. The Administrator reported that there is one issue left to resolve, and that is that the closing statement for 2620 Rice Street did not indicate the payment of special assessments for the demolition of the house which had been on the property. The Administrator indicated that it is not the intent of the City to absorb these costs. Jay Reiling, Wild North LLC, indicated that it was his understanding that at the time they purchased the property, this assessment was paid.
