MINUTES <br />CITY COUNCIL <br />SEPTEMBER 8, 1999 <br />development agreement relating to this issue based on a review and <br />recommendation from the Parks & Recreation Commission. <br />The City Administrator reported that Mr. Pratt would like approval of the <br />development agreement this evenin~ so that he can commence <br />construction of utilities. The Administrator reported that the Council has <br />the ability to made modifications to the development agreement at a later <br />date. <br />Fahey indicated that he was open on the trail issue, but indicated that he <br />felt a 12-foot wide trail was too wide. Pratt indicated that he will continue <br />to work on the trail issue. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI. UTION NO. 99-9-240 - APPROVING THE TWIN I,AKE <br />PINES DEVEI,OPMENT ACREEMENT WITH THE <br />MODIFICATIONS DISCUSSED REI.ATING TO THE <br />DESICNATION OF OUTI.OT A AS PONDING AND <br />PERMANENTLY UNDEVELOPED OPENSPACE, A.S WELI, AS <br />THE REQUIREMENT THAT THE DEVELOPER WAIVE THE <br />RIGHT TO APPEAI. SPECIAI. ASSESSMENTS FOR WATER MAIN <br />IMPROVEMENT, THE CITYATTORNEYADDRESSING THE <br />ISSUE OF RECORDING OF THE DE-/ELOPMENT AGREEMENT <br />AGAINST TH~ SDB.IECT PROPERTIES, AND .SU73JECT TO <br />REVIEW AND COMMENT ]3Y THE FIRE CHIEF ON THE ISSUE <br />OF FIRE PROTECTION FOR THE PROPOSED HOMES IN THE <br />TWIN LAKE PINES ADDITION <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaValle, Morelan, Scalze, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />GOODYEAR The City Administrator presented the Council with a purchase agreement <br />TIRE STORE for the City's purchase of the car wash property on Rice Street as well as <br />PROJECT the property immediately south and 2620 Rice Street from Wild North <br />LLC. The Administrator reported that there is one issue left to resolve, <br />and that is that the closing statement for 2620 Rice Street did not indicate <br />the payment of special assessments for the demolition of the house which <br />had been on the property. The Administrator indicated that it is not the <br />intent of the City to absorb these costs. <br />Jay Reiling, Wild North LLC, indicated that it was his understanding that <br />at the time they purchased the property, this assessment was paid. <br />
