MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 1999 <br />McCumber pointed out that the northeast corner of Edgerton Street and <br />County Road D is a freeway corner. He pointed out that the property on <br />the north side of County Road D is located in Vadnais Heights and is <br />commercial property. There is commercial property to the east of the <br />McCumber site, with McCumber pointing out that there are only four <br />houses between. There are residential uses on the other two sides. <br />McCumber reported that he has owned his property for 24 years and has <br />operated his business from this property for the past 22 years. McCumber <br />indicated that t6e value of his property as an industrial use out-strips any <br />potential residential use of the site. McCumber felt it did not make <br />financial sense to rezone the property. <br />Scalze pointed out that there is residential usa~e on three sides of the <br />McCumber and Buetow properties. <br />McCumber noted that a fair amount of the residential development in the <br />area happened after his business was already located at the site. <br />McCumber asked if the Council has looked at the dollar value of rezoning <br />this site. <br />Scalze replied that the dollar impact has not been looked at and pointed <br />out that the Council is a policy-making body. <br />Mrs. McCumber indicated that none of the property owners in the area <br />wants the property to be rezoned. Mrs. McCumber suggested that the City <br />is looking for trouble if it does so. <br />Fahey suggested that people will sign petitions because they do not want <br />to be a bad neighbor, and indicated that the Council is not privy to what <br />the people were told when they were asked to si~n the petition. Fahey <br />suggested it would be bad policy for the Council to make decisions based <br />on popularity contests. Fahey noted that variances are not ~ranted on the <br />basis of how neighbors feel given that there would not be equal treatment <br />in the case where neighbors were in favor of one variance, but opposed to <br />another. <br />Fahey pointed out that the issue of the zoning of these properties came <br />about as a result of the Buetow's request for a CUP for open and outdoor <br />storage and the impact this would have on the neighborhood. Fahey noted <br />that the Comp Plan indicates a residential land use for this property, and it <br />is required that the Comp Plan and the Zonin~ of properties be compatible. <br />Mr. Buetow pointed out that they purchased their property relying on its <br />I-1 zoning. <br />
