MINUTES <br />CITY COUNCIL <br />NOVEMBER 10, 1999 <br />Zoch agreed that while Mr. Lee was supposed to construct the fence as <br />part of his development, when they raised the issue with the City, no <br />enforcement occurred. Zoch reported that when Mr. Zoch proposed to <br />move a house as part of his development plan, the City indicated that the <br />house could not be moved until the fence was constructed. The City then <br />allowed the house to be moved without forcin~ the fence issue. <br />The City Administrator reported that there is a benefits received issue with <br />this improvement and the Zoch property. The Administrator suggested <br />that if the project were assessed today, the City would likely not assess the <br />Zoch property given there is no connection to the water main that would <br />be established. <br />Fahey asked the effect of deleting the assessment on the bond issue. The <br />City Administrator replied that the bonds have been retired on a solvent <br />basis. He also noted that deferments are not factored into the cash flow of <br />bond issues. <br />Fahey suggested that the assessment be deleted provided that the Zoch's <br />sign a release for the fence. <br />Mrs. Zoch reported that there is another issue she would like resolved. <br />She reported that they recently had their property surveyed and found that <br />their front property line was moved approximately 20 feet back. Zoch <br />reported that they are not aware of si~;ning any documents ~iving up this <br />property and would like to know what happened. <br />The City Administrator indicated that it would be difficult to determine <br />what happened without any documents to refer to. One way to find out <br />what happened would be for the Zoch's to have title work done on their <br />property. However, the City Administrator offered to research the City's <br />records to the extent possible to see if he can find out what happened. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI,UTION NO. 99-11-232 - DEI.ETING THE DEFERRED <br />ASSESSMENT ON THE ZOCH PROPERTY AT 2945 CONDIT <br />STREET PROVIDED THAT MR.
