MINUTES <br />CITY COUNCIL <br />NOVEMBER 22, 1999 <br />HOURS OF LaValle reported that he has been approached by the owner of a liquor <br />OPERATION- establishment in the City requesting that his business be allowed to stay <br />LIQUOR open after hours on New Year's Eve. No alcohol would be served after <br />ESTABLISH- 1 a.m., but softdrinks and food would be. <br />MENTS <br /> The City Attorney pointed out that the City Code prohibits liquor <br /> establishments from being open after 1:30 a.m. Therefore, the Code <br /> would have to be amended to accommodate this request. There is no <br /> limitation in State Statutes regarding hours of operation, however. <br />Council discuss this request and it was felt there may be problems with <br />allowing a bar to remain open after I:30 a.m. when the bars will have to <br />refuse to sel] liquor to patrons. It was also noted that if the bar owner <br />actively promotes the fact that the bar will be open after hours, this may <br />cause additional problems. Given the fact that this request is coming at <br />this late date and the Council would not have adequate time to study the <br />issues involved, it was the consensus of the Council to refuse the request. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESO7. ON.IANUARY 1, 2000 <br />The fore~oing resolution was duly seconded by LaValle. <br />Ayes (2) LaValle, Pedersen. <br />Nays (3) Fahey, Scalze, Morelan. Resolution denied. <br />PARKS & Scalze suggested that the recent outgoing members of the Parks & <br />RECREATION Recreation Commission be surveyed to determine their reasons for <br />COMMISSION resignin~ from the Commission. Morelan suggested that perhaps the <br />Commission itself should discuss the matter to determine if there is a <br />problem that the Council should be made aware of. <br />ADJOURN Mr, Morelan introduced the following resolution and moved its adoption: <br />RESOI.UTIONNO. 99-71-Z51-ADJOURNING <br />The fore~oing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, LaValle, Fahey, Pedersen. <br />Nays (0).
