<br /> 703-1 <br /> 703. INTOXICATING LIQUOR <br /> <br />703.010. LICENSE REQUIRED. It shall be unlawful for any person, firm or corporation to <br />keep or operate an on-sale or off-sale intoxicating liquor establishment within the limits of the City <br />without first having obtained a license to do so as hereinafter provided. <br /> <br />703.020. TYPES OF LICENSES. There shall be six (6) types of licenses issued for the sale <br />of intoxicating liquor, namely: <br /> <br />(a) On-sale restaurant intoxicating liquor license shall permit the sale of intoxicating <br />liquor for consumption on the premises in conjunction with the consumption of food. <br /> <br />(b) On-sale intoxicating liquor license shall permit the sale of intoxicating liquor for <br />consumption on the premises. <br /> <br /> (c) On-sale restaurant-event center intoxicating liquor license shall permit the sale of <br />intoxicating liquor for consumption on the premises in conjunction with the consumption of food. <br /> <br />(d) Off-sale intoxicating liquor license shall permit the sale of intoxicating liquor in <br />original packages for consumption off the premises only. <br /> <br />(e) Temporary on-sale intoxicating liquor licenses shall permit the sale of intoxicating <br />liquor for a specific period pursuant to Section 703.110. <br /> <br />(f) On-sale 2:00 a.m. intoxicating liquor license shall permit the sale of intoxicating <br />liquor for consumption on the premises between the hours of 1:00 a.m. and 2:00 a.m. <br /> <br />703.030. MINIMUM STANDARDS FOR "ON-SALE RESTAURANT" INTOXICATING <br />LIQUOR LICENSE. The following minimum requirements must be satisfied prior to the issuance <br />of an "On-Sale Restaurant" intoxicating liquor license. <br /> <br /> (1) Building Area. A restaurant building containing a minimum of 1,500 square feet used <br />for seated dining purposes, including the bar area but excluding the area used for kitchen, storage, <br />restroom facilities, waiting areas, and entrance and exit purposes. <br /> <br />(2) Seating Capacity. A restaurant building having appropriate facilities and adequate staff <br />to serve meals at tables and, for seating not less than 90 guests at one time for meals, including <br />seating available for food service in the bar area but excluding seating in a lounge or waiting area. <br /> <br />(3) Maximum Liquor Sales. The combined sale of intoxicating liquor, wine or 3.2 percent <br />malt beverages shall not exceed 40 percent of the restaurant's gross yearly sales. Evidence of <br />compliance with this requirement shall be furnished by licensee with annual renewal information <br />submitted to City. <br />
