NORTHWEST ASSOCIATED CONSULTANTS, INC. <br /> 4500 Olson Memorial Highway, Suite 202, Golden Valley, MN 55422 <br /> Telephone: 763.231.2555 Facsimile: 763.231.2561 planners@nacplanning.com <br /> MEMORANDUM <br /> <br /> TO: little Canada Planning Commission <br /> FROM: Stephen Grittman <br /> DATE: August 6, 2009 <br /> RE: Little Canada -Code Amendment for Lots of Record and Simple <br /> Subdivision <br /> FILE NO: 758.10 - 09.06 <br /> Background and Analysis <br /> Two housekeeping amendments to the Zoning and Subdivision Ordinances are <br /> proposed to clarify the status and zoning requirements of lots of record, and the process <br /> for allowing "simple subdivisions", especially when a simple lot line adjustment is <br /> proposed. <br /> The first amendment adds the phrase "existing lots of record" to the R-1 zoning district <br /> lot size standards section that was changed to refer to lots that have received <br /> "preliminary plat" approval. Because there are a number of existing lots that were <br /> subdivided years ago by metes and bounds (rather than platting), the change proposed <br /> clarifies that those previously existing lots are included in the original R-1 lot size <br /> requirements. <br /> That section will read as follows: <br /> 905.050. LOT REQUIREMENTS AND SETBACKS. For existinglots of record and property <br /> preliminary platted into buildable lots prior to March 1, 2008, the following minimum <br /> requirements shall be observed in an "R-1"District subject to additional requirements, <br /> exceptions and modifications set forth in this Ordinance. <br /> The second amendment is to the Subdivision Ordinance relating to administrative <br /> approvals for subdivisions that consist of lot combinations or "simple subdivisions" in <br /> which only one additional lot is being created or a lot line location is being adjusted. <br /> The change is to add the language "simple subdivision" to the existing text to clarify <br /> when this section is being used.
