To Honorable Mayor, Council Members, and Planning Commission: <br /> I am requesting a variance to the five-foot set back requirements of a pylon sign. <br /> I purchased the property at 2526 N. Rice Street approximately one year ago. The existing tenant <br /> A is ASAP Sign Shop which has been leasing rental space A for about 15 years. Rental space B <br /> has been leased to Pappa Murphy's Pizza. While working on a pylon sign it was discovered that <br /> the sign does not meet our five-foot set back requirement. <br /> Background on the existing pylon sign is that it was hit by a car that ran off of Rice Street <br /> approximately 7-10 years ago. The concrete base of about 3 ft x 4 ft was broken into pieces. The <br /> sign pylon was bent about 15 degrees to the North. The cabinet was bent and the faces were <br /> japed open, and the rain and elements basically have destroyed the inside lighting and wiring. <br /> I straightened the pylon and was in the process of repairing the concrete base. Instead of using a <br /> wooden form, pouring the concrete base and removing the wood form and leaving the concrete <br /> base as the outside finish, I decided to use brick for the concrete form to bring the look of the <br /> base more up to our architectural guidelines. When it was known that Che sign does not meet the <br /> five-foot set back requirement all repair was stopped. <br /> In trying to re-locate a new pylon sign which would meet our five-foot set back requirement, I <br /> discovered the sign was in a 35 foot Williams pipeline easement. I contacted Clair Madsen the <br /> Damage Prevention Maintenance Operator of Magellan Pipeline. I-Ie came out, located the <br /> pipelines and verbally stated that the pipelines were only about four feet deep and that they <br /> would not allow a foundation type structure to be located in their easement. He will put this <br /> down in a letter and forward it to me within a week. <br /> I believe this special condition particular to the land does not allow me to reasonably re-locate <br /> the pylon sign to meet out five-foot set back requirement. 'T'herefore, I am asking for a variance to <br /> our five-foot set back requirement. <br /> My proposal is to get the sign as close as possible to our architectural guidelines and city codes. <br /> • Re-configure the cabinet to meet our 16 foot high maximum height requirement <br /> • Remove existing light fixture on top of cabinet <br /> • Allow brick base to remain to comply with our architectural guidelines <br /> • Fill brick base half-way with concrete and remainder with black dirt and do planting for <br /> aesthetic value <br /> • Size of re-configured cabinet would be 9 ft x 7 ft <br /> • 4 ft x 9 ft would be for Pappa Murphy's Pizza and 3 ft x 9 ft would be for ASAP Signs <br /> <br /> This would put the sign cabinet approximately 7 inches off The Rice Street property line and <br /> <br /> approximately 3 feet off Demont property line. <br /> <br />
