<br /> MINUTES <br /> CITY COUNCIL <br /> SEPTEMBER 23, 2009 <br /> Administrator indicated his initial reaction that the insurance terms <br /> exceeded statutory limits of liability. State Law was changed effective <br /> July 1, 2009 increasing these limits of liability, therefore, the documents <br /> are in order and the City's insurance coverage through the League of MN <br /> Cities is adequate. <br /> Keis asked why the City enters info the note with the County rather than <br /> the condominium associations directly. The City Administrator noted that <br /> the City will certify the HIA fees for collection with property taxes. The <br /> City then receives those payments from the County, and the funds are used <br /> for repayment on the note. This is similar to when the City sells bonds to <br /> finance a project. <br /> Keis asked what liability issues there might be that the City has to have <br /> insurance for. "fhc City Administrator reported that the insurance <br /> requirement is standard and covers airy liability issues relative to the <br /> project that might result in the County being named in a lawsuit. <br /> The Administrator reported that Fleur Royale reduced the amount of <br /> County money fi•om what they initially requested, eliminating the funding <br /> of deck work from the County money. The reason for that is that <br /> prevailing wages would have to be paid for the deck work if County <br /> money were used, which would substantially increase Fleur Royale's cost <br /> of deck improvements. The County money will be used to pay for <br /> elevator work at Fleur Royale. <br /> It was noted that there may be an additional $100,000 in County money <br /> available, and the Administrator indicated that he would looking into <br /> whether or not that money could be used toward the Canabury Square HIA <br /> project. <br /> Mr. Montour introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2009-9-226 -APPROVING PROMISSORY <br /> NOTES AND LOAN AGREEMENTS WITH RAMSEY COUNTY <br /> RELATIVE TO THE CANABURY CONDOMINIUMAND FLEUR <br /> ROYALE HOUSING IMPROVEMENT AREA PROJECTS AND <br /> AUTHORIZING THE MAYOR AND CITYADMINISTRATOR TO <br /> EXECUTE THESE DOCUMENTS ON BEHALF OF THE CITY <br /> The foregoing resolution was duly seconded by Boss. <br /> Ayes (4). <br /> Nays (0).
