Montour recommended that the raceway color match <br /> the color of the building mansard. Duray agreed with this change. The <br /> Plaimer noted that the Code >?nforcement Officer is aware of this issue and <br /> will address it when sign permits are applied for. <br /> Montour noted that there are no plans at this time for signage on the south <br /> side of the building. Duray replied that this is correct. However, the Code <br /> does allow building signage per frontage. <br /> There was no one else present from the general public wishing to <br /> comment on this matter. <br /> Upon motion by Keis, seconded by Montour, the public hearing was <br /> closed. <br /> Mr. Keis introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2009-10-256 - APPROVING A CONDITIONAL <br /> USE PERMIT FOR COMPREHENSIVE SIGN PLAN FOR 2526 RICE <br /> STREET AS REQUESTEDBYMR. TOMDURAYSUBJECTTO <br /> COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY <br /> PLANNER AS OUTLINED IN HIS REPORT DATED SEPTEMBER <br /> 30, 2009 <br /> The foregoing resolution was duly seconded by Blesener. <br /> Ayes (5). <br /> Nays (0). Kesolution declared adopted. <br /> Mr. Montour introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2009-10-257 - APPROVING A VARIANCE TO <br /> ALLOW THE REPAIR AND EXPANSION OF THE EXISTING NON- <br /> CONFORMING PYLON SIGN TO ENCROACH FARTHER INTO <br /> THE REQUIRED SETBACK FOR 2526 RICE STREET AS <br /> REQUESTEDBYMR. TOMDURAYBASED ON THE FINDINGS <br /> OF FACT THAT THE PYLON EXISTS IN THE MAGELLAN <br /> PIPELINE EASEMENT WHICH ENCUMBERS THE SOUTH THIRD <br /> OF THE PROPERTYAND RELOCATING THE SIGN OUTSIDE <br /> THE EASEMENT AREA WOULD RESULT IN THE <br /> ENCUMBRANCE OF SIGNAGE FOR THE NORTHERN <br /> NEIGHBORING PROPERTYAS WELL AS INTERNAL TRAFFIC <br /> SAFETY ISSUES, NOTING THAT THE CURRENT LOCATION OF <br /> THE PYLON SIGN IS A REASONABLE USE OF THE PROPERTY <br /> AND THE PYLON IS BEING BROUGHT MORE INTO <br /> 5 <br /> <br />
