MINUTES CITY COUNCIL OCTOBER 28, 2009 Montour noted that the plans show the raceway for the Papa Murphy's sign will be white. Montour recommended that the raceway color match the color of the building mansard. Duray agreed with this change. The Plaimer noted that the Code >?nforcement Officer is aware of this issue and will address it when sign permits are applied for. Montour noted that there are no plans at this time for signage on the south side of the building. Duray replied that this is correct. However, the Code does allow building signage per frontage. There was no one else present from the general public wishing to comment on this matter. Upon motion by Keis, seconded by Montour, the public hearing was closed. Mr. Keis introduced the following resolution and moved its adoption: RESOL UTION NO. 2009-10-256 - APPROVING A CONDITIONAL USE PERMIT FOR COMPREHENSIVE SIGN PLAN FOR 2526 RICE STREET AS REQUESTEDBYMR. TOMDURAYSUBJECTTO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN HIS REPORT DATED SEPTEMBER 30, 2009 The foregoing resolution was duly seconded by Blesener. Ayes (5). Nays (0). Kesolution declared adopted. Mr. Montour introduced the following resolution and moved its adoption: RESOLUTION NO. 2009-10-257 - APPROVING A VARIANCE TO ALLOW THE REPAIR AND EXPANSION OF THE EXISTING NON- CONFORMING PYLON SIGN TO ENCROACH FARTHER INTO THE REQUIRED SETBACK FOR 2526 RICE STREET AS REQUESTEDBYMR. TOMDURAYBASED ON THE FINDINGS OF FACT THAT THE PYLON EXISTS IN THE MAGELLAN PIPELINE EASEMENT WHICH ENCUMBERS THE SOUTH THIRD OF THE PROPERTYAND RELOCATING THE SIGN OUTSIDE THE EASEMENT AREA WOULD RESULT IN THE ENCUMBRANCE OF SIGNAGE FOR THE NORTHERN NEIGHBORING PROPERTYAS WELL AS INTERNAL TRAFFIC SAFETY ISSUES, NOTING THAT THE CURRENT LOCATION OF THE PYLON SIGN IS A REASONABLE USE OF THE PROPERTY AND THE PYLON IS BEING BROUGHT MORE INTO 5
