<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> OCTOBER 28, 2009 <br /> CONFORMANCE WITH CITY CODEAND ARCHITECTURAL <br /> GUIDELINES <br /> The foregoing resolution was duly seconded by Boss. <br /> Ayes (5). <br /> Nays (0). Resolution declared adopted. <br /> Mr. Duray noted that Papa Murphy's is planning to open the first part of <br /> December. <br /> AMENDMENT Mayor Blesener opened the Public Hearing to consider an Amendment to <br /> TO ZONING the Zoning Code relative Yo the threshold number of lots that determines <br /> CODE - a simple subdivision. 1t was noted that the City Planner and the Planning <br /> SIMPLE Commission have recommended approval of the Code amendment. <br /> SUBDIVISIONS <br /> The City Plazmer indicated that historically the City has treated simple <br /> subdivisions as lot splits creating up to three lots. The Subdivision Code <br /> establishes that threshold at two. The Planner indicated that he is not sure <br /> exactly when the change was made, but noted the City's historical <br /> treatment of this issue. The ordinance amendment proposed would sync <br /> up the Code with that historical practice. <br /> Keis asked if the City would have control over unique pieces of property <br /> and be able to apply the platting standards when necessary. The City <br /> Planner indicated that the City would have to authority to require a full <br /> plat if it was felt necessary. The Planner noted that the real impact of the <br /> change is Yhat simple subdivisions are subject to a smaller lot standards <br /> than are plats. A simple subdivision allows a 10,000 square foot lot acid <br /> 75 feet minimum street frontage. The platting standards require an 11,000 <br /> square foot lot and an 85 foot minimum street frontage. <br /> Blesener asked about the situation where a large parcel would propose a <br /> three lot simple subdivision and then come back in a couple of years <br /> asking for anoUrer three lots. The City Planner indicated that the intent <br /> would be not Yo permit this situation, and noted that the Code requires a <br /> concept plan for any undeveloped property. If that situation existed, the <br /> City has the discretion to require the property to be platted. <br /> Tho City Attorney felt the best way to handle this situation is through the <br /> concept approval process. The property could be required to be platted <br /> and held to the new standards. <br /> There was no one else present from the general public wishing to be heard <br /> on this matter. <br /> 6 <br /> <br />
