<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> OCTOBER 28, 2009 <br /> Upon motion by Montour, seconded by McGraw, the public hearing was <br /> closed. <br /> Mr. McGraw introduced the following resolution aild moved its adoption: <br /> RESOLUTION NO. 2009-10-258 - APPROVING ANAMENDMENT <br /> TO THE ZONING CODE RELATIVE TO THE THRESHOLD <br /> NUMBER OF LOTS THAT DETERMINES A SIMPLE <br /> SUBDIVISION, CHANGING THAT NUMBER FROM TWO TO <br /> THREE <br /> 'fhe foregoing resolution was duly seconded by Montour. <br /> Ayes (5). <br /> Nays (0). Resolution declared adopted. <br /> REVOCATION Mayor Blesener opened the Public Hearing to consider revocation of <br /> OR YUD the PUD Permit for open and outdoor storage of materials and equipment <br /> 1'EI2MIT - as an accessory use at 3151 Cowltry Drive, Tony Costanzo and Maly <br /> 3151 COUNTRY Pasching. The Mayor indicated that this consideration is being taken <br /> DRIVE - code compliance issues on this property. <br /> COSTANZO <br /> AND The City Administrator reported that the PiJD Permit was issued in <br /> rASCHING January of 2000. The key components of the approval were as follows: <br /> o No outdoor storage in front of the building lines; <br /> o Screening of storage areas between the two buildings with <br /> wood fencing; <br /> o Installation of doors on the eastern structure; <br /> o Establishment of 24 parking spaces; <br /> o Outdoor storage to be neat and orderly; <br /> o No junk or debris on the site. <br /> The Administrator indicated that there are two tenants of the Costanzo <br /> property that were not contemplated by this approval, those being <br /> Minnesota Asphalt which has building space and the other Vision Tree <br /> Services which has no building space and has au outdoor storage use only. <br /> At the time of the PUD approval there was a roofing and electrical <br /> equipment on the property. The addition of MN Asphalt and Vision Tree <br /> was a violation of the PUD Permit. However, if both of these compa~iies <br /> maintained their storage within the buildings, they could have been <br /> compliant. <br /> The Administrator then reviewed recent pictures of the property showing <br /> the outdoor storage violations that exist. The Administrator noted that the <br /> property has never been compliant since the issuance of the PUD Permit in <br /> 2000. This is one of the least compliance properties in Kyan Industrial <br /> park, and revocation of the PUD Permit is warranted. <br /> 7 <br /> <br />
