<br /> MINUTES <br /> CITY COUNCIL <br /> <br /> NOVEMBER 23, 2009 <br /> It was noted that the applicant is not present this evening to answer any <br /> questions. The application was provided with a copy of the Fire Marshal's <br /> report recommending denial. <br /> There was no one present from the general public wishing to comment on <br /> this matter. <br /> Upon motion by Boss, seconded by Keis, the public hearing was closed. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> RESOLUTIONNO. 2009-I1-278 -DENYING THE REQUEST FOR <br /> SPECIAL USE PERMIT FOR HOME OCCUPATION RELATED TO <br /> THE FABRICATIONAND REPAIR OF DENTAL DEVICES <br /> REQUESTED BYJOE CHER DONA YANG, 30 OLD COUNTYROAD <br /> C EAST, BASED ON THE FINDINGS OF FACT AS OUTLINED IN <br /> THE CITY FIRE MARSHAL'S NOVEMBER 17, 2009 REPORT <br /> RELATIVE TO THE FACT THAT THE MATERIALS USED ARE <br /> HIGHLY FLAMMABLE, EXPLOSIVE, AND WOULD GENERATE <br /> HAZARDOUS WASTE AS WELL AS BASED ON THE FIRE CODE <br /> VIOLATIONS ON THAT EXIST ON THE PROPERTY RELATIVE <br /> TO THE OPERATION OF A HOME OCCUPATION OF THIS <br /> NATURE <br /> "the foregoing resolution was duly seconded by Keis. <br /> Ayes (5) <br /> Nays (0). Resolution declared adopted. <br /> INTERIM USE Mayor Blesener opened the Public Hearing to consider the request for an <br /> PERMIT & Interim TJse Permit allowing outdoor display space for lawn care items <br /> AMENll PUD - and propane exchange cage as well as an Amendment to PUD Permit for <br /> 2920 RICE Comprehensive Sign Plan at 2920 Rice Street requested by .Tames <br /> STREET - Schwalbach for the new I Iardware I-Iank location. It was noted that both <br /> HARDWARE the City Planner and the Planning Commission have recommended <br /> HANK approval of the request. <br /> The City Planner reviewed his November 9, 2009 report in detail. He <br /> noted that the proposed outdoor storage area would be located on the south <br /> side of the building and would take up approximately four parking stalls. <br /> The Planner noted that the site is overparked, therefore, the loss of these <br /> four parking stalls will have no significant impact. The outdoor storage <br /> area will be fenced with wrought iron fencing. The Planner noted that the <br /> Planning Commission recommended approval of the IUP for outdoor <br /> display space subject to identification offence materials and subject to an <br /> agreement being executed that would provide for expiration of the IUP <br /> upon expiration of the applicant's lease of this property.
