<br /> MINUTES <br /> CITY COUNCIL <br /> APRIL 14, 2010 <br /> HIMMELBACH The City Administrator reported that in order to avoid the need <br /> & BATTISTA for sanitary sewer lift stations in the northeast quadrant of the City, <br /> PROPERTIES - the Northeast Utility Connection Improvement has been ordered. <br /> EASMENT This improvement will extend sanitary sewer from the Beam Avenue/ <br /> ACQUISITION Kohlman Lane area to the Gervais Woods development. The <br /> Administrator noted that utility easements are needed fiom the <br /> Himmelbach and Battista properties to provide for this saiitary sewer <br /> connection. <br /> The Administrator reviewed the details of the Battista easement <br /> acquisition, summarizing that the recommended compensation totals <br /> $69,950 and includes the land costs, land damages, impact to dwelling, <br /> appraisal allowance, and eminent domain avoidance. The Administrator <br /> also indicated that the estimated assessment to the Battista property for the <br /> Northeast Utility Improvement is estimated at $78,162 (based on the <br /> potential for six lots). The City Administrator recommended that <br /> easement costs offset the assessment amount for the Northeast iJtility <br /> Connection. This will allow the project to move forward on a timely basis <br /> and avoids the need for eminent domain. <br /> With regard to the Himmelbach easement acquisition, the Administrator <br /> summarized easement costs at $29,900 which include land costs, appraisal <br /> allowance, and eminent domain avoidance. The estimated cost of the <br /> Northeast Utility connection assessment to the Iimmelbach property is <br /> $39,081 (based on the potential for three lots). The Administrator <br /> reported that Mr. Himmelbach would prefer payment for the easement <br /> acquisition and an assessment to his property for the improvement costs. <br /> It would be Mr. Himmelbach's intent to then request a deferment of the <br /> assessment until his property is developed. <br /> The City Administrator also noted that Right-Of--Entry Agreements will be <br /> needed for both properties to allow the City Engineer to have the property <br /> surveyed to facilitate design of the sanitary sewer line. <br /> Mr. Montour introduced the following resolution and moved its adoption: <br /> RESOLUTIONNO. 2010-4-90-AUTHORIZING UTILITY <br /> EASEMENT ACQUISITION FOR THE BATTISTA AND <br /> HIMMELBACH PROPERTIES AS OUTLINED BY THE CITY <br /> ADMINISTRATOR, SUBJECT TO APPROVAL AND ACCEPTANCE <br /> BY MR. BATTISTA AND MR. HIMMELBACH <br /> The foregoing resolution was duly seconded by Boss. <br /> Ayes (5). <br /> 15 <br /> <br />
