7. The provisions of Section 921.010.C of this Ordinance are <br /> considered and satisfactorily met. <br /> Staff Response. Section 921.010.C establishes criteria from which <br /> conditional use permit applications are to be evaluated. According to the <br /> Ordinance, the Planning Commission's judgment must be based upon the <br /> following factors: <br /> 1. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed action has been considered in relation to the <br /> specific policies and provisions of and has been found to be <br /> consistent with the official City Comprehensive Land Use Plan. <br /> 2. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed site is or will be compatible with present and <br /> future land uses of the area. <br /> 3. The applicant shall demonstrate by clear and convincing evidence <br /> That the proposed use conforms with all performance standards <br /> contained herein. <br /> 4. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed use will not tend to or actually depreciate the <br /> aggregate property values in the area in which the amendment or <br /> conditional use is proposed. <br /> 5. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed use can be accommodated with existing public <br /> services and will not overburden the City's service capacity. <br /> 6. The applicant shall demonstrate by clear and convincing evidence <br /> that the development of the conditional use shall reflect the <br /> architectural character of the conforming buildings in the <br /> surrounding area in regard to the following: <br /> a. Proportion, scale and roof line; <br /> b. Architectural style; and <br /> c. Exterior finish materials. <br /> Provided certain conditions are imposed, it is believed the preceding <br /> evaluation criteria can be satisfied. <br /> <br /> Additional Requirements <br /> In addition to the preceding I-P District requirements, it will be necessary for the <br /> applicant to secure a separate business license for the proposed outdoor storage <br /> activities. As conditions of license issuance, the following additional requirements also <br /> apply: <br /> 3 <br /> <br />
