<br /> MINUTES <br /> CITY COUNCIL <br /> MAY 12, 2010 <br /> PREMISE The City Clerk reviewed the application for a Premises Permit to conduct <br /> PERMIT FOR lawful gambling at Gas N Go submitted by the Canadian Days Committee. <br /> GAS N GO - The Clerk noted that the concept of allowing lawful gambling at gas <br /> CANADIAN station/convenience stores was discussed by the City Council at its April <br /> DAYS 28°i meeting, and the consensus was to allow lawful gambling to be <br /> operated from one gas station/convenience store in the City on a six- <br /> month trial basis. The Clerk reported that she discussed this concept with <br /> the State Ganibling Control Board. The State now issues Gambling <br /> Licenses and Premises Permits on a perpetual basis, and will not deviate <br /> from that practice. However, they indicated that the City can be more <br /> stringent than State Law in this regard. The City Clerk indicated that <br /> current City Code provides that the City can revoke a Gambling License <br /> or Premises Permit for any reason. Therefore, the Council's options <br /> include issuing the Premises Permit, reviewing it after six months, and <br /> revoking if there are problems or concerns; or the Council can amend the <br /> Code and provide for asix-month permit for all new licenses/and or <br /> premises permits. The City Clerk noted that the City Attorney has <br /> reviewed these options and concurs. <br /> The City Administrator pointed out that Canadian Days has been along- <br /> established organization in the City. Should the City have concerns with <br /> the Premises Permit at a gas station/convenience store, Canadian Days <br /> would work cooperatively with the City. <br /> The City Clerk further noted that the City's Lawful Gambling Ordinance <br /> has not been updated for quite some time, and indicated that City staff will <br /> be bringing some recommended updates to the Council for consideration <br /> at a future meeting. <br /> The Council noted its previous discussion at the Apri128°i meeting <br /> relative to allowing one Premises Permit at a gas station/convenience store <br /> on a six-month trial basis. The Council was still in consensus with that <br /> position. <br /> Mr. Blesener introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2010-5-120 - APPROVING A PREMISES <br /> PERMIT FOR CANADIAN DAYS AT GAS N GO EFFECTIVE JUNE <br /> 1, 2010 BASED ON CANADIAN DAYS' INDICATION THAT IT <br /> WILL WORK COOPERATIVELY WITH THE CITY RELATIVE TO A <br /> CONDITION THAT THERE BE A SIX-MONTH REVIEW OF THAT <br /> PERMIT TO DETERMINE WHETHER OR NOT THERE ARE ANY <br /> PROBLEMS OR CONCERNS WITH THE OPERATION OF LAWFUL <br /> GAMBLING FROM A GAS STATION/CONVENIENCE STORE AND <br /> WHETHER OR NOT THERE IS A REASONABLE BENEFIT FROM <br /> 4 <br /> <br />
