Montreux stated that for economic reasons Mr. Heckel needs to <br /> occupy the property for both his residence and business. <br /> Duray stated that he would support some type of business use for the <br /> trucking oompany on a limited basis, but would not support the residential <br /> use. Hail noted that the adjacent property has a residential use that can <br /> continue indefinitely. The City Planner indicated that as long as there is <br /> continuous residential use of the property to the south, that use can <br /> continue. It is considered to be legally non-conforming. <br /> Hall stated that he was not sure the City intended to see the property go <br /> into foreclosure. Duray agreed that the City would not want to see that <br /> happen, but the Code cannot be changed based on that possibility. <br /> Montreux asked why the residential use cannot be allowed. The City <br /> Planner noted that the PUD zoning would accommodate the residential use <br /> if it were consistent with the Comp Plan. He noted that the long-term use <br /> for this area as listed in the Comp Plan is commercial. The Planner also <br /> indicated that if the inclination is to go in that direction, then the permit <br /> should be temporary with a defined time limit. <br /> Everson suggested that if there is no use of the property it may eventually <br /> be a burden for the City. He also noted that property values are going <br /> down. Everson noted that under the PUD zone, the City could allow the <br /> request subject to conditions. If the property is sold or a developer comes <br /> in, the City cair move the property toward commercial status. Everson <br /> stated that he did not like the idea of going backwards, but felt a short term <br /> permit of perhaps a year with conditions may be a solution. Everson felt <br /> the situation did not have to be all or nothing, and indicated that he would <br /> like to see something positive happen with the property. <br /> Again, Duray indicated that he would like to work out something with the <br /> property in the back. <br /> Hall asked for clarification on the discontinuance of the residential use of <br /> the property. The City Planner noted that once the residential use was <br /> vacated for a period of time, that legally non-conforming use expired. The <br /> property has been zoned PUD for quite a few years, and the Comp Plan <br /> states the expectation that the property will be redeveloped to a <br /> commercial use. <br /> -7- <br /> <br />
