MINUTES <br />PLANNING COMMISSION <br />APRIL 14, 2011 <br />the list of allowable uses in the PUD -B District subject to compliance with <br />the recommendations of the City Planner as outlined in his report dated <br />April 7, 2011, and instructing the Planner to also add "sports training" as <br />an allowable use in the PUD -B District to reflect current uses of the <br />building. <br />Motion seconded by Murphy. <br />Motion carried 4 — 0. <br />CUP & The City Planner noted that Lee Rossow has requested a Conditional Use <br />VARIANCE — Permit for outdoor storage, including storage containers, as well as a <br />3165 Variance from the side yard setback requirement in the I -1 District for <br />SPRUCE — property located at 3165 Spruce Street. <br />LEE ROSSOW <br />Knudsen noted that the applicant is not present this evening to answer <br />questions. He pointed out that the applicant is proposing to construct a <br />new building at 3165 Spruce Street, and indicated that there have been <br />outdoor storage issues on this property under the previous ownership. <br />The City Planner noted that Mr. Rossow has purchased the adjacent <br />parcels at 3165 Spruce Street and 3167 Spruce Street. 3165 Spruce was <br />used for outdoor storage and as an auto sales lot. The property is no <br />longer being put to that use, and Mr. Rossow is proposing to clean up both <br />properties. Mr. Rossow is proposing to construct a multi- tenant building <br />on 3165 Spruce Street. He is seeking a CUP for outdoor storage for future <br />tenants, as well as a Variance that would allow him to construct the <br />building 5 feet from the property line adjacent to 3167 Spruce Street. <br />The Planner noted that in order for a Variance to be approved, there must <br />be conditions present that create unreasonable restrictions in putting the <br />property to use without the Variance. Those conditions cannot be <br />economic in nature nor can they be created by the applicant. The Planner <br />noted that the property is approximately 100 feet wide. Of that 100 foot <br />width, 50 feet is under an Xcel Energy power line easement, and a <br />building cannot be constructed under that easement. Mr. Rossow is <br />hoping, however, to negotiate with Xcel for the allowance of a portion of <br />the building to encroach on the easement area. The Planner noted that <br />normally a 100 foot wide lot would have 70 feet of buildable area. Given <br />the 50 foot Xcel easement and the 15 foot side yard setback requirement, <br />there is only 35 feet of buildable area. <br />Knudsen noted that the City has had issues with lot widths and smaller <br />buildings in Ryan Industrial Park.
