JOINT POWERS AGREEMENT <br />For the <br />Trail and Boardwalk Extension <br />This Agreement is between the <br />And the <br />City of Little Canada <br />515 East Little Canada Road <br />Little Canada MN 55117 <br />City of Maplewood <br />1830 County Road B East <br />Maplewood MN 55109 <br />Whereas, the City of Little Canada and the City of Maplewood desire to connect the trail systems <br />that currently exist in each city near Walter Street, LaBore Road and County Road D; <br />Whereas, the residents of both the City of Little Canada and the City of Maplewood would <br />benefit from the connection of the trail system; <br />Whereas, The City of Little Canada and the City of Maplewood recognize that it is economically <br />beneficial to design and construct the project jointly as a single project; <br />Whereas, plans and specifications for the trail and boardwalk construction have been prepared by <br />Sanders Wacker Bergly, Inc., Landscape Architects and Planners; <br />Whereas, the staff and Park Commission from the City of Little Canada and the City of <br />Maplewood have reviewed and approved the plans; <br />Whereas, the City of Little Canada and the City of Maplewood are authorized pursuant to <br />Minnesota State Statutes Section 471.59, commonly known as the Joint Powers Act, to <br />enter into a Joint Powers Agreement; <br />Whereas, the City of Little Canada and the City of Maplewood desire to enter into this <br />Agreement for the purpose of establishing the rights, responsibilities and obligations of <br />the parties regarding the design, construction, management and maintenance of the <br />Project. <br />Now, Therefore, in consideration of the mutual covenants contained herein, the City of Little <br />Canada and the City of Maplewood hereby agree as follows: <br />Description of the Project <br />The Project, as shown on the attached construction drawings, Exhibit A, sheets L 1 through L5, <br />shall consist of a bituminous trail (8' width) and a boardwalk (10' width), along with <br />related landscaping. <br />The Project, as shown in the attached drawings, begins near Walter Street, where the new trail <br />will connect with the existing Maplewood Trail on the east side of Walter Street. The <br />new trail will extend west of Walter Street approximately 700 feet to connect with the <br />Page 1 of 7 <br />
