6. Grants and Loans. The City and the Redeveloper agree to cooperate with <br />each other to pursue grant and other loan funding sources that may contribute to the <br />Development Project such as contaminated soil remediation funds. <br />7. Construction of Improvements. The minimum improvements for the <br />Property shall be constructed pursuant to plans that are developed with and approved by <br />the City as part of the final Development Agreement. Said plans shall also be developed <br />in accordance with the Commercial Development Areas Architectural Guidelines dated <br />June 1996, a copy of which Developer hereby acknowledges receipt. <br />8. Developer Contingencies. Redeveloper acknowledges that the completion <br />of the Development Project is a high priority for the City. The Developer agrees that the <br />contingencies in Developer's favor set forth in a future Development Agreement shall be <br />limited to title and survey matters, environmental and soil conditions matters, obtaining <br />governmental approvals, including approvals of construction plans, financing and the <br />satisfaction by the City of its obligations under the Development Agreement. <br />9. Developer Updates. To keep the City fully apprised of the status of the <br />development, the Developer shall provide the City with a monthly progress report. Said <br />report is due by last day of each month during the term of this agreement. Said report <br />shall address, at a minimum, marketing contacts made and the results of same, any <br />schematic drawings prepared for the development associated with the marketing of the <br />property or contemplated development, and any issues associated with potential tenants <br />that create land use compliance issues. <br />10. Legislative Judgment. The Developer understands that many of the <br />actions which the City may be called upon to take require its reasonable discretion, and in <br />some instances, its legislative judgment. Such actions may only be made following <br />established procedures, and the City cannot agree, in advance, to any specific decision in <br />such matters. <br />11. Notices.
