Size of Accessory Buildings. Section 903.020 D. 4 of the Zoning Ordinance <br />requires that the total floor area of a garage and other accessory buildings on a single <br />family lot shall not exceed one thousand (1,000) square feet, unless by conditional use <br />permit. Conditions of such a CUP are as follows: <br />1. In no instance shall the total floor area of a garage and an accessory <br />building for a single family dwelling exceed one thousand five hundred <br />(1,500) square feet. <br />The accessory building and /or garage cannot exceed ten (10) percent of <br />the rear yard. <br />3. If a CUP is granted to exceed 1,000 square feet for a garage or accessory <br />building, the additional shed is not allowed and if one exists, it must be <br />removed. <br />The applicant is proposing a 30 ft. 10 in. x 42 ft. 7 in. (1,307) square foot and a 20 x 12 <br />(240) square foot accessory building, totaling 1,547 square feet. The request exceeds <br />the maximum allowed square footage by 47 square feet. However, the detached <br />garage is proposed as a 2 story building, with storage space below. The allotted 1,500 <br />square feet for accessory structure area is calculated as floor area. As such, the <br />proposed second floor would count as well. Since the basement area is below grade, <br />this area would not be counted against the 1,500 square foot maximum. <br />The applicant has plans of eventually building a new single family home, which would <br />be attached to the proposed garage, and the second floor would be utilized as livable <br />area. This may be acceptable at that time as it would reduce the floor area of the <br />accessory structure, but our office can only review what is being requested at this time, <br />which is a 2 story garage which greatly exceeds the maximum 1,500 square foot <br />allowance for accessory structure area. <br />Accessory Structure Building Height. Section 903.020 D. 2. notes that accessory <br />buildings in residential zoning districts must not exceed 15 feet in height. No <br />dimensioned elevations have been provided, but our office would assume that a two <br />story garage with eventual living space above exceeds 15 feet in height. <br />Accessory Structure Location. Section 903.020 D. 2. b. states that accessory <br />buildings are not allowed closer to the front lot line than the rear building line of the <br />principal structure, except by CUP. Allowing an accessory building in front of the rear <br />building line of the principal structure is considered to be a special exception, <br />conditioned upon the following: <br />1. The accessory building or shed is screened from the view of the public <br />street with fencing and /or landscaping. <br />2. The architectural appearance of the accessory building is reasonably <br />coordinated with the principal structure. <br />2 <br />
