Placement of the accessory shed shall not detract from the appearance of <br />the streetscape and shall be consistent with the character of the <br />neighborhood. <br />The applicant does have a relatively large lot, approximately 2 acres, which may reduce <br />the visual concern from the public road. The applicant did provide a site plan identifying <br />some landscaping. Should the City approve the request, our office would recommend <br />some additional screening along the west side of the smaller accessory building. <br />Building Code. The plans for the smaller 20 x 12 (240) square foot building show <br />that the building will rest on class 5 with no cement slab or foundation. The building <br />official will need to comment as to whether this would be acceptable. <br />CONCLUSION <br />The Ordinance allows a total of three accessory buildings (1 detached or attached <br />garage, 1 recreational building (160 square feet) and 1 shed with a total floor area not to <br />exceed 1,000 square feet. The floor area may exceed 1,000 square feet via a CUP <br />provided the conditions of the Ordinance are adhered to, including a maximum floor <br />area not to exceed 1,500 square feet. The Ordinance does not allow accessory <br />buildings to exceed 15 feet in height and does not allow accessory buildings to be <br />closer to the front lot line than the rear building line of the principal building. <br />The proposed request has a number of issues with the Zoning Ordinance standards. <br />Some of these issues would be addressed if or when a home is constructed and the <br />upper floor of the proposed garage is utilized as living area. Other issues, such as the <br />size and location of the smaller accessory building would not be resolved by future <br />actions. <br />Approval of the request would require conditions that may be difficult to enforce, <br />including limitations on private access or use of enclosed upper areas of the building. <br />As such, the City may deny the request, as proposed, based on a finding that the <br />request does not meet the performance standards required for approval of a conditional <br />use permit as defined in the ordinance. <br />Should the City approve the proposed Conditional Use Permit, planning staff would <br />recommend the following conditions: <br />1. The total floor area being used as a garage and other accessory buildings shall <br />not exceed 1,500 square feet. <br />2. The applicant shall make arrangements with the building official to prohibit <br />access or use of the upper floor until such time as the building is attached to a <br />principal building. At this time, it may be finished as livable area. <br />3 <br />
