3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property <br />values in the area in which the amendment or conditional use is proposed. <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of <br />the buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roof line; <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Zoning Ordinance Section 921.030.A. <br />A. Purpose. The purpose of a conditional use permit is to provide the City of Little Canada <br />with a reasonable degree of discretion in determining the suitability of certain designated uses <br />upon the general welfare, public health and safety. In making this determination, whether or not <br />the conditional use is to be allowed, the City may consider the nature of the adjoining land or <br />buildings, whether or not a similar use is already in existence and located on the same premises <br />or on other land immediately close by, the effect upon traffic into and from the premises, or on <br />any adjoining roads, and all other or further factors as the City shall deem a prerequisite of <br />consideration in determining the effect of the use on the general welfare, public health and <br />safety. <br />Comments on each of these standards are provided in the following section: <br />921.010 <br />Comprehensive Plan Consistency. The Comprehensive Plan makes note of <br />enforcement issues related to outdoor storage in the Ryan Industrial Park <br />area, and promotes improvements to the area through building <br />improvements, greater controls on outdoor storage, and paving standards. <br />The applicants are proposing no improvements to the site that would address <br />these goals. <br />The Comprehensive Plan further states that projects should be evaluated <br />from the standpoint that if it "cannot show that it enhances the community <br />environment, the project should be redesigned or rejected in favor of one that <br />does." With no improvements to the site, and a significant history of zoning <br />violations, there is no evidence that the proposed request would meet this <br />goal statement. <br />Policy statements relating to industrial uses in this area include the following: <br />
