as B (Business) occupancy. As long as the motor vehicle repair garage has hazardous <br />materials within the allowable quantities, it is classified as an S- 1(Storage) occupancy <br />otherwise the repair garage moves into an H (Hazardous) occupancy and more restrictive <br />codes apply. Dwelling portions of buildings shall be classified as R (Residential) <br />occupancy's. While it is more common than not to have mixed occupancies in the same <br />building, provisions must be made to separate and protect the occupants and property. <br />Dwelling units must be provided with complete independent living facilities for <br />one or more persons, including permanent facilities for living, cooking, sleeping, eating, <br />and sanitation. The space provided for the occupant has none of the facilities required by <br />code. <br />Little Canada Zoning Code 914 the Little Canada Zoning Map identifies this <br />address as I -1, Light Industrial District, which does not allow as a permitted use, dwelling <br />units or any residential use. <br />Corrective Action: Complete a permit application form, available from the City of Little Canada, <br />for the change in use /repair and remove the sleeping area and its contents and return the area back <br />to its original use. The application and plans will be reviewed by the code official for code <br />compliance and approved only if all code provisions are met. <br />Occupancy Separation - IBC Section 302.3.3 requires that each portion of the building <br />be classified as to its use and shall be completely separated from adjacent areas by fire <br />barrier walls having a specific rating. Table 302.3.3 requires a 3 hour separation between <br />the business office portion, (B occupancy) and the repair garage (S -1 occupancy). The <br />separation is allowed to be reduced by one hour if the building is provided with an <br />automatic fire- extinguishing system throughout per IBC Section 302.3.3, Exception 1. <br />The office /garage separation wall has unsealed penetrations and a door with no <br />label indicating what the rating is and is not self - closing and tight fitting with the proper <br />gasket materials. <br />Corrective Action: Submit documentation along with a permit application for review to the City <br />of Little Canada which indicates the type, rating and closure apparatus for the door separating the <br />office from repair garage which is 2 -hour or 3 -hour depending on if the building is provided with <br />sprinklers. Also seal all penetrations in the wall separating the two occupancies. <br />Roof Coverings- IBC Section 1503 Roof coverings are required to be designed installed <br />and maintained in accordance with the code and the installation instructions approved by <br />the manufacture and must protect the building and structure from the weather. Every <br />building shall be weather protected to provide shelter for the occupants against the <br />elements and protection for the building. In my review of the stricture it is evident that <br />leaking has occurred over a period of time due to the staining on the sheetrock ceiling and <br />holes that have developed in it. Staining and damage has also taken place around <br />penetrations such as furnace vents. <br />While it is not possible to determine how long the leaks have been present, it is <br />my opinion the leaks have caused damage to the building and must be evaluated by a <br />- 2 1 - <br />
