MINUTES <br />CITY COUNCIL <br />NOVEMBER 9, 2011 <br />DEVELOPER The City Administrator noted that the City sold a lot at Rice Street/Viking <br />DEPOSIT Drive to R. J. Marco (JRR Holdings). R. J. Marco developed the Subway <br />BILLING — project on that lot. The Administrator reported that due to title problems <br />R.J. MARCO- that had to be resolved, the closing on the property was delayed. These <br />SUBWAY title problems stemmed from vacation actions, etc. that occurred many years <br />PROJECT ago in the turn -back of Viking Drive from the State. <br />As a result of these title problems and the delay in closing on the property, R. J. <br />Marco incurred additional costs of the project in the amount of $12,003, as <br />outlined in their letter dated September 8, 2011. R. J. Marco owes the City a <br />balance of $2,619.84 in zoning processing costs, and has asked that the City <br />forgive this balance in light of the additional expenses that they incurred. The <br />City Administrator stated that given the delay caused by the City, staff would <br />recommend that this outstanding balance be forgiven. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -11 -221— WAIVING THE UNPAID DEVELOPER <br />DEPOSIT BALANCE OF $2,619.84 AS REQUESTED BY R. J. MARCO <br />(JRR HOLDINGS) DUE TO THE ADDITIONAL COSTS INCURRED <br />GIVEN THE CITY'S DELAY IN GETTING THE MELANCON PLAT <br />RECORDED <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />TERRACE The City Administrator reviewed the property swap between the City and <br />HEIGHTS Terrace Heights Mobilehome Park which resulted in the City having <br />LAND SWAP adequate right -of -way along County Road B -2 to install an additional turn lane. <br />DEEDS The Administrator pointed out that the acquisition of the Hostess Bakery site <br />was also a part of this project. The Administrator noted that the Council <br />previously approved the property divisions /combinations relative to the land <br />swap. The appropriate deed have now been prepared for Council approval. <br />Blesener noted that the retaining wall /landscaping project along County Road <br />B -2 is underway and pointed out the aesthetic improvements to the area. The <br />City Administrator reported that the landscaping will be completed in the spring. <br />Blesener also noted the vast improvement of the entire area as a result of the <br />Highway 36 /Rice Street project and encouraged those who have not to drive <br />through the area to see these improvements. <br />Blesener introduced the following resolution and moved its adoption: <br />4 <br />
