The PUD District is designed to provide for the integration and coordination of and <br />parcels as well as the combination of varying types of residential, commercial and <br />industrial uses. As part of the PUD, the City has the ability to address the appearance of <br />a proposed structure in order to ensure a high quality development product. Among <br />other elements, a PUD is intended to encourage: <br />+ Higher standards of site and building design through the use of trained and <br />experienced and planners, architects and landscape architects; <br />+ More convenience in location of accessory commercial and service areas; <br />• A development pattern in harmony with the objectives of the City Comprehensive <br />Plan. <br />Allowing tattoo parlors in the PUD District only would allow the city to establish higher <br />performance standards, have discretion over building design, and integrate such <br />establishments with a variety of other commercial uses. <br />Location. To further limit the presence of tattoo and body piercing establishments, the <br />City may choose to enforce additional location restrictions. When Brandon Heffron <br />submitted his application for a text amendment to allow tattoo parlors in the B -3 District, <br />much of the opposition stemmed from the fact that the area he chose was partially <br />surrounded by single family residential homes. Residents were concerned with the <br />site's close proximity to a school bus stop and the effect a tattoo parlor would have on <br />their neighborhood. A portion of the PUD District along Rice Street also abuts an area <br />zoned R -1, Single Family Residential. Several of the other PUD Districts in the City <br />also abut residential districts. <br />One option to prevent tattoo parlors from having a negative impact on residential <br />districts would be to establish a minimum setback requirement from residential districts, <br />churches, and schools. A tattoo parlor may be considered a more intense use than <br />other commercial businesses, making them less appealing near residential districts. <br />Establishing a minimum setback requirement would allow for a buffer between <br />residential areas and potential tattoo parlors. In addition to a setback, proper screening <br />in accordance with Section 903.020 (G) may also be required to serve as a buffer. <br />License. Requiring a license for tattoo and body piercing establishments would allow <br />the City to have a certain amount of discretion over persons owning tattoo and body <br />piercing establishments, the individuals performing tattooing and piercing procedures, <br />and the establishments where tattooing and piercing procedures are performed. The <br />purpose of the license is to regulate the business of tattooing and piercing in order to <br />protect the health and welfare of the public. Through the license process, things such <br />as skin preparation procedures, liability and insurance binders, and health and <br />sanitation requirements can be covered. Staff would recommend that a license be <br />required to allow such a use as doing so will achieve the following: <br />1. Assist in preventing disease transmission <br />2. Correct and prevent conditions that may adversely effect patrons utilizing a tattoo <br />and body piercing establishment <br />3. Provide standards for the design, operation, and maintenance of tattoo and body <br />piercing establishments <br />
