Drywall Supply Addition <br />Development Contract <br />20. Developer shall instruct his engineer to provide adequate field inspection personnel <br />to ensure the project is constructed in accordance with approved plans and specifications. In <br />addition, the City's Engineer, at Developer's expense, shall also inspect the construction of <br />General Improvements for the purpose of certifying the same and recommending acceptance by <br />City. Developer shall also complete construction staking for the project at Developer's expense. <br />21. An as -built survey will be required to verify elevations of each structure. <br />Required Improvements <br />22. General Improvements. The General Improvements include: a private road to <br />provide access to Lots One, Two and Three; the extension of water main and services; the <br />extension of sanitary sewer main and services; storm sewer; grading; paving; concrete curb and <br />gutter; and, lighting. All such General Improvements shall be completed on or before November <br />15, 2003, at Developers expense. Original plans or subsequent changes for said General <br />Improvements shall be provided to the City Engineer and shall be in accordance with City <br />specifications and standards. The General Improvements shall be in compliance with the <br />Reciprocal Easement and Maintenance Agreement, by and between Developer and District <br />Council 82, a copy of which is attached hereto and incorporated herein as Exhibit C. No <br />financial assistance is being provided by the City as to the General Improvements. <br />23. Lot One. As a condition precedent to this Contract, Developers sale and <br />conveyance of Lot One to District Council 82 must occur. Lot One is to be developed pursuant <br />to this Contract and the Planned Unit Development Plat. The Developer must assist District <br />Council 82 as necessary to comply with this Contract. Lot One is to include a new building <br />which will consist of approximately 57,000 square feet. The canopies currently present on Lot <br />One shall be removed on or before December 31, 2003. District Council 82 shall enter the <br />Reciprocal Easement and Maintenance Agreement which is attached hereto as Exhibit C. <br />District Council 82 shall also enter a Parking Easement Agreement with Developer, a copy of <br />which is attached hereto and incorporated herein as Exhibit D, to provide for shared parking. <br />- 6 - <br />
