Drywall Supply Addition <br />Development Contract <br />landscaped pursuant to City requirements. Such screening and landscaping shall be completed <br />on or before June 1, 2004. Outdoor storage of materials on Lot Three, by Drywall Supply will <br />be allowed, as long as the specifics of such storage such as location, aisle width, turning area, <br />height, and type of materials are previously approved by the City. However, any such storage <br />shall not include the receipt, transfer, storage, holding or distribution of products for any <br />business or entity other than Drywall Supply. No other or additional outdoor storage shall be <br />permitted on Lot Three. A gravel surface for outdoor storage on Lot Three is acceptable subject <br />to appropriate maintenance standards and such gravel surface must be installed prior to any <br />storage occurring on Lot Three. All uses of Lot Three must be part of Drywall Supply's <br />operations. No financial assistance is being provided by the City as to the Required <br />Improvements on Lot Three. <br />Easements <br />26. Developer shall acquire and dedicate easements as necessary for the construction <br />and maintenance of the Required Improvements pursuant to City requirements, including, but not <br />limited to utility easements for sanitary sewer and water systems and any other easements the <br />City deems appropriate. Developer shall pay all costs relating to the acquisition of the necessary <br />easements, including attorney's fees, costs, appraisals, the cost of the necessary property, and <br />any other special conditions which Developer shall negotiate with any affected property <br />owner(s). Developer also agrees to reimburse City for any costs associated with the acquisition <br />of the easements including drafting, review and recording. <br />27. Developer shall obtain consents to any required easements as necessary. <br />28. Developer hereby grants City, its agents and employees, a license to enter any of <br />Developer or District Council 82's property to perform all necessary work, maintenance and/or <br />inspections deemed appropriate by the City during the construction of the Required <br />- 8- <br />
