MINUTES <br />CITY COUNCIL <br />JANUARY 25, 2012 <br />VACATION <br />OF DRAINAGE <br />& UTILITY <br />EASEMENT <br />AND <br />DEDICATION <br />OF <br />REPLACEMENT <br />EASEMENT — <br />ST. JUDE <br />MEDICAL <br />VOUCHERS <br />Mayor Blesener opened the Public Hearing to consider the vacation of <br />a drainage and utility easement on the St. Jude Medical property. <br />The City Administrator reported that as part of St. Jude Medical's <br />parking ramp construction, a water main had to be relocated. This water <br />main was moved about 20 feet and ended up outside the existing <br />easement. Therefore, the existing water main easement should be vacated, <br />and St. Jude is dedicating a replacement easement for the new water main <br />location. The Administrator reported that St. Jude has some new legal <br />staff which is currently reviewing the new easement document. Therefore. <br />he recommended that the vacation not be recorded until the new easement <br />document is finalized. <br />"There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Keis, seconded by Montour, the public hearing was <br />closed. <br />Mr. Montour introduced the tollowing resolution and moved its adoption: <br />RESOLUTION NO. 2012 -1 -21— VACATING THE EXISTING <br />DRAINAGE AND UTILITY EASEMENT AS REQUESTED BY ST. <br />JUDE MEDICAL CONTINGENT UPON DEDICATION OF A <br />REPLACEMENT DRAINAGE AND UTILITY EASEMENT WITH <br />VACATION DOCUMENT TO BE RECORDED UPON RECEIPT OF <br />THE REPLACEMENT EASEMENT <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -1 -22 — APPROVING THE VOUCHERS <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0).
