MINUTES <br />CITY COUNCIL <br />FEBRUARY 22, 2012 <br />OF THE CITY PLANNER AS OUTLINED IN HIS FEBRUARY 3, <br />2012 REPORT <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />CUPs — Montour opened the Public Hearing to consider the application for <br />200 & 202 Conditional Use permits for indoor, retail used -car sales dealerships at <br />RYAN 200 and 202 Ryan Drive as requested by Russ Fischer. The property is <br />DRIVE — located in the Light - Industrial (1 -1) Zoning District. It was noted that <br />RUSS the Planning Commission has recommended approval subject to <br />FISCHER compliance with the recommendations of the Code Enforcement Officer <br />as outlined in her February 1, 2012 report. <br />The City Planner noted that Russ Fischer has requested approval of two <br />Conditional Use Permits to operate indoor auto sales lots at 200 and 202 <br />Ryan Drive. This property previously has a CUP for an indoor auto sales <br />lot, but that CUP has been lapsed for a few years. The Planner noted that <br />there are other tenants of this property who do auto repair, and these <br />tenants have outdoor storage of customer vehicles on the property. There <br />would be no outdoor storage allowed in conjunction with indoor auto sales <br />lot. <br />The Planner noted that the Zoning Ordinance outlines a series of <br />conditions that must be met in order to operate indoor auto sales. The <br />Code Enforcement Officer and the Fire Marshal have reviewed the <br />property and find it to be in compliance. Therefore, City staff is <br />recommending approval of the CUPs as requested subject to there being <br />no outdoor storage in conjunction with these CUPs. <br />Keis asked if there were two CU Ps for indoor auto sales previously. Russ <br />Fischer, property owner, indicated that there was only one CUP for indoor <br />auto sales. He noted that his building is divided into four rental spaces. <br />The CUPs being requested would be for the units at 200 and 202 Ryan <br />Drive. <br />Keis asked if there was a limit on the number of indoor auto sales licenses. <br />The Planner replied that there is no limit in indoor auto sales licenses, only <br />outdoor. <br />McGraw asked if the businesses in question would also be doing auto <br />repair. Fischer replied that they would be doing light body work, but not <br />major auto repair. There would be no clips of vehicles stored on the <br />3 <br />
