MINUTES <br />CITY COUNCIL <br />FEBRUARY 22, 2012 <br />been determined that given the grades of the area and the cost to improve a <br />street that does not provide access to anyone, the project is not feasible. <br />Roberto suggested that if the City is not planning to improve Rose Lane in <br />the future, then the right -of -way should be vacated. However, the City has <br />decided to maintain this right -of -way which Roberto felt was an indication <br />that it could go through. Roberto was concerned that if the street is <br />improved, the result would be storage in a front yard abutting an improved <br />street. The City Planner suggested that the Council could place a <br />condition on the Variance approval that should Rose Lane be improved, <br />the Variance would lapse and the storage would have to be removed. <br />The City Administrator reported that staff's position is that it is not <br />feasible to improve Rose Lane. He noted that this was the position of the <br />City Engineer at the time the house at 298 Rose Lane was built. The <br />Administrator also noted that the right -of -way is being maintained as there <br />is a sanitary sewer line within that right -of -way. Roberto pointed out that <br />it is feasible to maintain the sanitary sewer line within a 10 foot easement <br />rather that a 50 foot right -of -way. <br />Roberto then pointed out that the Anderson property is 100 feet wide by <br />227 feet deep, being one of the larger lots in the City. Roberto felt that <br />there was adequate space on the property for storage in the rear yard. <br />Roberto pointed out that the City Planner's report talks about the extreme <br />side elevations and difficulties in accessing the rear yard. Roberto <br />reviewed a picture of the side elevation on the east side of the house and <br />indicated that he would not categorize these side elevations as being <br />extreme. Roberto pointed out that at the Planning Commission meeting <br />Anderson talked about acquiring an additional trailer and log splitter <br />indicating that he would store these in the rear yard. Roberto indicated <br />that if the slopes are so extreme, this would preclude any storage in the <br />back yard. Roberto also pointed out that it is his understanding that there <br />is no trade -off for the storage in the front yard; therefore, a Variance <br />would only increase the area of the property that could be used for storage. <br />Roberto stated that it appears to him that there is adequate room and <br />means to store on the Anderson property in compliance with the Code. <br />Roberto stated that his concern is that storage in the northeast corner of the <br />Anderson property results in an extension of the driveway. Roberto <br />pointed out that the Anderson driveway is screened from view of Savage <br />Lane and would be a good location for storage of the boat and trailer. <br />Roberto noted from the pictures that the grass area up to the storage area <br />in question is worn away and is just an extension of the driveway. <br />Roberto stated that he has a boat and stores it off site during the winter <br />months. Roberto felt that storage of the boat on the driveway during the <br />boating season was reasonable. <br />7 <br />
