MINUTES <br />CITY COUNCIL <br />FEBRUARY 22, 2012 <br />Roberto felt that if the Variance is approved, Anderson gains an advantage <br />as he would be allowed to have storage on an unimproved street. Keis <br />noted that the storage will have to be located on Anderson's property, not <br />on the road right -of -way. The City Planner indicated that the intention of <br />his recommendation and the Planning Commission's is that the storage <br />occurs on Anderson's private property. Montour stated that it is his <br />understanding that the existing wood pile is on the Anderson property. <br />The previous storage shown in a picture submitted by Mr. Roberto was in <br />the right -of -way, but has been removed. <br />Roberto noted that Anderson indicated at the Planning Commission <br />meeting that he may acquire an additional trailer and would store that in <br />his back yard. Roberto also again expressed concern that the front yard <br />storage area being requested would expand. <br />Roberto also noted the fire pit in the Anderson front yard and indicated <br />that it does not comply with Code. He indicated that the Code requires a <br />fire pit be 25 feet from structures and vehicles. The fire pit is located at <br />the edge of the Anderson driveway. Roberto stated that he has had flying <br />embers on his patio from this fire pit, and was concerned that the wood <br />pile was closer to the fire pit than his patio is from the fire pit. Roberto <br />felt both his home and the Anderson home were at risk Roberto presented <br />a copy of the City Code which requires the 25 foot distance from a <br />structure and /or vehicle. Montour noted that the fire pit is more than 25 <br />feet from the house. Amy Roberto pointed out that the fire pit is adjacent <br />to the driveway. She indicated that Anderson backs his truck up to the fire <br />pit and unloads wood. She was concerned with the proximity of the truck <br />to the fire pit. The City Administrator indicated that the City could have <br />the Fire Marshal look at the situation. The Administrator indicated that <br />the Code appears to indicate that at the time the fire pit is being used, a <br />vehicle cannot be within 25 feet of it. Sam Roberto indicated that 922.010 <br />of City Code says that if a Variance request increases fire risk, it is not <br />consistent with the Code. Roberto felt that the existence of 2 to 4 cords of <br />wood as well as a boat with a gas tank in the front yard of the Anderson <br />property would increase the fire risk. Montour stated that the City would <br />have the Fire Marshal review the situation. The City Administrator <br />indicated that the fire pit may increase the fire risk, rather than the <br />Variance request for outdoor storage in the front yard. Amy Roberto <br />reported that Mr. Anderson uses accelerants on his fires, and she has sent <br />him a letter informing him that this is a Code violation and asking him to <br />stop. Montour agreed that that was a serious issue, but indicated it was not <br />related to the Variance request. <br />Roberto referred to the fact that the Anderson fire wood storage is also <br />non - compliant and Anderson's comments that he will not bring wood pile <br />9 <br />
