II. TERM OF CONTRACT. This Contract shall be in full force and effect for a five -year period <br />beginning January 1, 2002 2007. <br />III. DEFINITIONS. For purposes of this Contract, the following terms shall have the following <br />meanings: <br />A. Additional Collection Service. Refuse in excess of the designated volume -base per <br />residential dwelling unit or residential dwelling units desiring collection of items from <br />a location other than the boulevard adjoining the curb. <br />B. Bulky items. Large household items including carpeting and padding, mattresses, <br />chairs, couches, tables, and other such items which are too large for one person to pick <br />up. <br />C. Collection Service. Collection service is a private operation engaged in collection and <br />transportation of refuse, yard waste and recyclables. <br />D. Day- Certain Collection. Day- Certain collection is a City- approved plan for weekly <br />collection services by an established day- certain schedule. This schedule requires <br />refuse, yard waste, and recyclable collection on the same day of the week and is based <br />on a five (5) day, Monday through Friday, workweek. The only exceptions to the <br />"day- certain" plan shall be during those weeks in which occur legal holidays. <br />E. Garbage. Garbage is organic waste, including discarded material resulting from the <br />handling, processing, storage, preparation, serving, and consumption of food. <br />F. Independent Contractor. Independent contractor means person or persons authorized <br />by the Contractor to perform refuse collection services within the City. <br />G. Prohibited Mailings. Mismailings Notices sent to residential dwelling units within the <br />City of Little Canada advertising rates or services not available under this contract. <br />H. Recyclables. Recyclables are reusable materials approved and agreed to by the parties <br />hereto. Recyclables shall may include such items as newspaper, catalogs, magazines, <br />phone books, junk mail, corrugated cardboard, ledgerpaper, bi -metal eeas and <br />aluminum cans, plastics with a neck, and glass containers. Recyclables specifically <br />exclude garbage, refuse and yard waste. <br />I. Refuse. Refuse is solid waste including garbage and rubbish, and specifically excluding <br />yard waste, recyclables, and toxic and hazardous wastes. Refuse further excludes <br />industrial, commercial, agricultural, and construction garbage or rubbish and wastes. <br />-2- <br />-4 <br />
