occupations shall require a permit in accordance with the terms of this subdivision. The <br />proposed use would require a special home occupation permit. <br />The requirements for a special home occupation permit are as follows: <br />1. No person other than a resident shall conduct the home occupation, except where <br />the applicant can satisfactorily prove unusual or unique conditions or need for non- <br />residential assistance and that this exception would not compromise the intent of this <br />Ordinance. <br />The proposed use would employ three people, two of which do not reside on the <br />property. Each of the employees will provide services, along with one manager which is <br />required by the State of Minnesota. The required presence of a manager may <br />constitute a need for non - residential assistance. staff would recommend that no more <br />than one non - residential employee be working on the site at any given time. <br />Section 2202 of the City Code of Ordinances regarding massage therapy as an <br />accessory use, states that no more than two massage therapist individual licenses will <br />be issued to any business establishment. A text amendment to allow massage therapy <br />in the R -1 District is also being considered at this time. This amendment would allow <br />massage therapy as an accessory use (home occupation), with no more than one <br />therapist at a time. <br />The applicant has not indicated if each of the employees will be performing massage <br />therapy, or other services. A maximum of two massage therapy licenses would be <br />permitted for the business. No employee may perform massage therapy services on <br />site without a proper license. <br />2. Examples of special home occupations include: barber and beauty services, <br />photography studio, group lessons, saw sharpening, small appliance and small <br />engine repair and the like. <br />The proposed spa use may be classified as "beauty services ", an example special <br />home occupation. A text amendment to allow massage therapy in the R -1 District is <br />also being considered at this time. <br />3. The home occupation may involve any of the following: stock -in -trade incidental to <br />the performance of the service, repair or manufacturing which requires equipment <br />other than customarily found in a home, the teaching with musical, dancing and <br />other instruction of more than one pupil at a time. <br />None of these activities are proposed. <br />4. Special home occupations may be allowed to accommodate their parking demand <br />through utilization of on- street parking. In such cases where on- street parking <br />facilities are necessary, however, the City Council shall maintain the right to <br />est blish the maximum nu; ,'tier of on street spac: s permitted and increase or <br />2 <br />
