• There shall be no exterior storage of equipment or materials used in the home <br />occupation, except personal automobiles used in the home occupation may be <br />parked on the site. <br />No exterior storage of materials will be necessary. <br />• The home occupation shall meet all applicable fire and building codes. <br />The home occupation shall be subject to all recommendations of the City Building <br />Official. The City of Little Canada also reserves the right to inspect the premises in <br />which the occupation is being conducted to insure compliance with the provisions of this <br />subdivision or any conditions additionally imposed. <br />• There shall be no exterior display or exterior signs or interior display or interior signs <br />which are visible from outside the dwelling. <br />A signage plan was not submitted with the application. As such, it is assumed that no <br />signage will be placed on site that would be visible from outside the dwelling. <br />• All home occupations shall comply with the provisions of the City Nuisance <br />Ordinance. <br />No nuisances are expected as a result of the spa operation. <br />• No home occupation shall be conducted between the hours of 10:00 p.m. and 7:00 <br />a.m. unless said occupation is contained entirely within the principal building and will <br />not require any on- street parking facilities. <br />The hours of operation will be 11:00 a.m. to 8:00 p.m. These hours are in compliance <br />with the ordinance. <br />Massage Therapy License. Section 2202 of the City's Municipal Code pertains to <br />licensing of massage therapists. This ordinance states that licenses may be granted <br />only to establishments associated with and operating within the confines of and <br />incidental to a properly zoned beauty parlor. As such, the applicant would not be eligible <br />for a massage therapy license. The City is considering a text amendment concurrent <br />with this application that would allow massage therapy as an accessory use in the R -1 <br />District. Any approval of a massage therapy license is contingent on the passing of this <br />amendment. <br />A license for massage therapy as an accessory use shall be reviewed annually. No <br />license approved by the City grants the licensee a property right or entitlement to a <br />license. The City Council may refuse to issue, refuse to renew, or may suspend or <br />revoke a license for any reason, and the City will not incur liability for any damages <br />including, but not limited to, direct, consequential, or incidental damages, deprivation of <br />property, loss of income, loss of profits, or loss of livelihood. <br />4 <br />
