• There shall be no exterior storage of equipment or materials used in the home occupation, except personal automobiles used in the home occupation may be parked on the site. No exterior storage of materials will be necessary. • The home occupation shall meet all applicable fire and building codes. The home occupation shall be subject to all recommendations of the City Building Official. The City of Little Canada also reserves the right to inspect the premises in which the occupation is being conducted to insure compliance with the provisions of this subdivision or any conditions additionally imposed. • There shall be no exterior display or exterior signs or interior display or interior signs which are visible from outside the dwelling. A signage plan was not submitted with the application. As such, it is assumed that no signage will be placed on site that would be visible from outside the dwelling. • All home occupations shall comply with the provisions of the City Nuisance Ordinance. No nuisances are expected as a result of the spa operation. • No home occupation shall be conducted between the hours of 10:00 p.m. and 7:00 a.m. unless said occupation is contained entirely within the principal building and will not require any on- street parking facilities. The hours of operation will be 11:00 a.m. to 8:00 p.m. These hours are in compliance with the ordinance. Massage Therapy License. Section 2202 of the City's Municipal Code pertains to licensing of massage therapists. This ordinance states that licenses may be granted only to establishments associated with and operating within the confines of and incidental to a properly zoned beauty parlor. As such, the applicant would not be eligible for a massage therapy license. The City is considering a text amendment concurrent with this application that would allow massage therapy as an accessory use in the R -1 District. Any approval of a massage therapy license is contingent on the passing of this amendment. A license for massage therapy as an accessory use shall be reviewed annually. No license approved by the City grants the licensee a property right or entitlement to a license. The City Council may refuse to issue, refuse to renew, or may suspend or revoke a license for any reason, and the City will not incur liability for any damages including, but not limited to, direct, consequential, or incidental damages, deprivation of property, loss of income, loss of profits, or loss of livelihood. 4
