Access. The proposed plat gains access form LaBore Road, and terminates in a single <br />cul -de -sac. This road has been revised from the original plan to include a more <br />prominent jog adjacent to Outlot A. As a result, the cul -de -sac length has increased <br />from 450 feet to approximately 530 feet, the size of Outlot A has been increased to .07 <br />acres, and the size of Lot 1 has been decreased to .46 acres. Lot 1 still meets all <br />setback and lot area requirements. <br />The City's Subdivision Ordinance states that cul -de -sacs shall not be longer than 500 <br />feet, including a terminal turn - around which shall be provided at the closed end, with a <br />right -of -way radius of not less than 50 feet. <br />The proposed cul -de -sac exceeds the maximum length allowed. The applicant has <br />submitted an application for a variance to allow a cul -de -sac approximately 30 feet <br />longer than what is permitted by the Ordinance. The purpose of restricting cul -de -sac <br />length is to eliminate the need for vehicles to travel for extremely long distances with no <br />option to turn around. <br />The purpose of the variance process is to grant relief from the literal provisions of the <br />Zoning Ordinance in instances where their strict enforcement would cause undue <br />hardship because of circumstances unique to the individual property under <br />consideration, and to grant such variances only when it is demonstrated that such <br />actions will be in keeping with the spirit and intent of the Ordinance. <br />The proposed length only slightly exceeds the maximum requirement, due to the <br />curvature of the road. The road was re- designed per the recommendation of the City <br />Engineer, requesting that a straight 100 -foot approach be provided up to the <br />intersection to allow for a perpendicular approach to LaBore Road. Moreover, there is <br />no practical alternative that would eliminate or lessen the length of the cul -de -sac in this <br />location due to property configuration, topography, and wetland areas. In that regard, <br />the requested variance may be found to be justified. <br />Grading, Drainage, and Erosion Control Plan. At the request of the City Engineer, <br />the applicant has submitted additional information relating to the grading, drainage, and <br />erosion control plan. The applicant shall be required to comply with all <br />recommendations of the City Engineer, as outlined in the October 23, 2006 memo from <br />Plowe Engineering, Inc. <br />Utility Plan. The applicant shall be required to comply with all recommendations of the <br />City Engineer regarding utilities, as outlined in the October 23, 2006 memo from Plowe <br />Engineering, Inc. <br />Stormwater. The applicant shall again be required to comply with all recommendations <br />of the City Engineer related to stormwater, as outlined in the October 23, 2006 memo <br />from Plowe Engineering, Inc. <br />3 <br />
