City of Little Canada, Minnesota <br />Ordinance No. <br />AN ORDINANCE AMENDING CHAPTER 205 OF THE LITTLE CANADA CITY CODE, <br />KNOWN AS THE MUNICIPAL CODE, AS RELATES TO SANITARY SEWER/SUMP <br />PUMP INSPECTIONS <br />The City Council of the City of Little Canada hereby ordains: <br />Section 1. <br />Section 205.080 is hereby amended to read as follows: <br />D. All properties in the City that discharge into the City's sanitary sewer system shall <br />be subject to an inspection by authorized city employees or agents to confirm <br />there is no sump pump or other prohibited discharge into the sanitary sewer <br />system. The purpose of the inspection shall be to confirm that there is no sump <br />pump or other prohibited discharge into the sanitary sewer system. <br />E. Upon verified compliance with this Section, the City reserves the right to request <br />reinspection of such property or structure at least annually to confirm continued <br />compliance. <br />F. Any owner of any property found to be in violation of this Section shall make the <br />necessary changes to comply with this Section within fourteen (14) calendar days <br />of notification from the City and such change shall be verified by authorized City <br />employees or its agents through a re- inspection of the property. A surcharge as <br />established by City Council Resolution is hereby imposed and shall be added to <br />every sewer billing, to property owners who are found not in compliance with this <br />Section. The surcharge shall be added every quarter until the property is verified <br />to be in compliance through the City's inspection program. <br />G. The Public Works Director, shall review and decide written requests for <br />temporary waivers from the provisions of this Section where strict enforcement <br />would cause a threat to public safety because of circumstances unique to the <br />individual property under consideration. Any request for a temporary waiver <br />from the provisions of this Section, the property owner shall agree to pay an <br />additional fee for sanitary sewer services based on the number of gallons <br />discharged into the sanitary sewer system as estimated by the Public Works <br />Director or his /her designee. <br />H. Any new buildings with sumps for which a building permit is issued after June 1, <br />1998, shall have a pump and shall he piped to the outside of the dwelling before a <br />certificate of occupancy is issued. <br />Violation of this Section is a misdemeanor and each day that the violation <br />continues is a separately prosecutable offense. The imposition of the surcharge <br />shall not limit the City's authority to prosecute the criminal violations, seek an <br />injunction in District Court ordering the person to disconnect the nonconforming <br />
