Conditional Use Criteria <br />The ordinance introduces clear CUP criteria for detached accessory buildings. The existing code allows <br />CUPs for oversized accessory structures but lacks findings and standards to guide the review process. <br />The proposed update provides defined criteria to support consistent staff analysis, Planning Commission <br />recommendations, and ultimately City Council decisions. <br /> <br />5. Accessory Dwelling Units (ADUs) <br />The proposed ordinance permits ADUs in the R-1, R-2, and R-C districts with the following standards: <br />• Permitted only on lots with a single-family dwelling <br />• ADUs permitted only within detached accessory buildings <br />o Accessory dwelling units attached to the home would be considered a duplex <br />and not permitted under this update <br />• May utilize existing utility connections if sufficient capacity exists <br />• May be assigned a separate address <br />• One off-street parking space required <br /> <br />To read the full text of the provisions specifically related to ADUs along with Staff notes, please see <br />Attachment C (page 28). <br /> <br />6. Exterior Building Materials <br />Existing standards for accessory building materials are vague and scattered across several sections. <br /> <br />The proposed ordinance consolidates and clarifies these standards, modernizes permitted materials, and <br />introduces clearer maintenance expectations. <br /> <br />Stricter material standards for multi-family housing and manufactured home parks remain unchanged. <br /> <br />7. Definitions and Interpretations <br />The amendments introduce a definition for “Building Footprint” and clarify setback measurements to <br />resolve internal inconsistencies. <br /> <br />Additional definitions for terms such as deck, patio, and ADU have been added to improve usability and <br />enforcement. <br /> <br />Planning Commission <br />The Planning Commission discussed the proposed ordinance updates at its September 11 meeting and provided <br />detailed direction to staff on specific standards. Staff returned with complete draft ordinances on October 23, <br />which the Commission unanimously recommended for approval (7-0). <br /> <br />The Commission’s discussion focused on several key policy areas: <br />1. Owner Occupancy for ADUs. <br />At its September meeting, the Commission initially supported requiring owner occupancy for ADUs. <br />After reviewing draft language in October, Commissioners reached consensus to remove this <br />requirement. They cited enforcement challenges, potential incentives for residents to avoid rental <br />registration, and the unfair favoritism such a provision would show toward homeowners over renters.
